Hello all,

We have been patiently waiting since we filed in May and calling and trying to make things move and not understanding why it was taking so long...

My husband finally got a call from his congressman liaison officer today and here is what he found out:

"I just got a call back from ... and he told me what they had been told by USCIS upon the inquiry. Somehow our petition file got put in July's received files and had not even been taken out of the receiving area where they are filed when received even with my repeated phone calls to the stupid USCIS. They pulled it and are asking the Congressman's office to give them another month to process the petition. If he does not hear back from them before Jan 21st, then he will make another inquiry into why it has not been processed.."

And with all the calls we have made, they had never noticed before it was misfiled... or is it another of their stories to get away with it... Still, we have to wait another MONTH again!

Good Luck to you and to USCIS - is there one area that they can excel in besides inefficency? Thank god your Congress person got involved and cheers to you for doing that and to them!!

I think this falls under the don't trust anything that USCIS says category, even if it is to a congressional liaison. Your sig says you filed the I130 in late May and got that NOA1 in late June. You then filed the I129F in late August and got that NOA1 in early September. Ok, so it is possible that the I130 was receipted, then hung around some pile or table or whatever, and got put in with the July received set. Fine. But K3s are usually adjudicated on the I129Fs timeline. So regardless of when the I130 was sent/received, if they linked the 2 in their system, you will be adjudicated along with the other August/September K3ers. They haven't gotten there yet from what I can tell from other people's posts. But they should by the end of the month early next month, and thus the estimate of waiting another month. The June/July pile for the I130 would make little difference unless they failed to link the petitions, but in that case, your June or July I130 under CR1 processing should have been approved awhile back (say before Thanksgiving).

You should have both petitions approved later this month. Good luck!
