On New Year's Eve, we met a couple at Sharm who have been waiting in AP for their K1 visa at Cairo for fifteen months since interview. I wasn't terribly surprised when I heard their story,but I was a little taken aback by how long they have been in AP. The petitioner was about 10 years older than her fiancé,but they definitely looked like a real couple as far as I was concerned. She had moved to Egypt six months ago to wait out the AP. She asked us how long we had waited and I told her seven weeks and the color left her face :( and I felt very sad for them.

So, I started thinking if perhaps Cairo is actually returning petitions under the guise of 'AP" and just holding the cases in visa purgatory until USCIS reaffirms/denies? I dunno. I looked at some timelines here and although there are some couples who have waited past ten months in AP, there is only one I saw that has passed the mark of this couple's wait. I am just throwing out ideas here. I told the lady she should definitely try to call DOS and get an updateon their case,but she said that no one at the embassy will even talk to them and just give the same canned "pending AP" response.

One other thing, she said they did have a home visit ,but his family agrees with their engagement. However, my husband said he got a different version from the fiancé and maybe the father did not agree. Anyway, I don't think that in itself should be enough to hold their petition up that long.

Any ideas?? We swapped numbers and I told her I would call her before I left to come back home. I did tell her that if she had not heard anything from the embassy in the next few months, to just get married and do DCF. I think that is right, but not even sure if she can get married anymore in Egypt.

I have thought this before,, but when you call DOS theu tell you your case is in Cairo. When a congressman does an inquiry they say your case is in Cairo. I think they are there because if they could deny them they would have. What adepressing idea to wake up too I just wanna go back to bed

I dont put a darn thing past Cairo. And too, we don't know everything to everyone's story. Every case is different, but then again, JODO, you could be on to something here.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

I think the bulk of us have our cases in Cairo though, not in Washington. If they were truly returned they'd already be at the USCIS wouldn't they?

I remember MaryandMian told me they were in AP for 2years in pakistan! so maybe cairo is just going to start taking longer. Another thing I know in my case they just did a home visit, and in ahmedandsues there case was just sent to dos for checks so it is possibble they are just taking longer to do things

I agree with Bridget, because if you call DOS they wouldn't lie and say your case is in Cairo, they would say I don't know or give some other answer.

Wow, JODO. Anything is possible, but a 221g will state clearly if the case is being returned to USCIS, rather than just "needs additional processing." (Perhaps we didn't get accurate reports from some members on exactly what their 221g stated, but most have checked for this statement very closely.)

Also, doesn't the petitioner in the US eventually get an NOID (Notice of Intent to Deny) once the file is back at USCIS ?

I am thinking back over cases we've seen -- I know there was at least one Cairo case with a 10-month AR wait after the interview, but the visa WAS issued.

I feel really sorry for this lady. If she didn't even know how her fiance's parents really felt about their plans to marry..... but the fiance felt free to tell new acquaintances the truth.... just.... wow.

Right??? I mean that's kind of weird if you ask me. Having the inlaws' approval over there is a BIG deal.

Well unfortunately there are all too many families in economically depressed countries who WILL go along with the charade in order to help their son attain the Holy Grail of the U.S. Green Card, so he can come to America where money falls from trees and they will all be fabulously rich.

Sorry but it's the truth.

That is true. They will take pictures with you, etc. So family taking their pictures with you isn't a sign either way.

Or maybe that she doesn't know?? I just think 15 months in AP is insane! Cairo should either deny them or approve them.

I agree. She needs to start pulling out the big guns and fight till she either dies on the battlefield or get some sort of resolve. 15 months IS crazy.
