My fiance entered in US with K1 Visa on Sept 15 2007. We married on Sept 22 and we had already applied her AOS right away on Oct 28 after she received her new SSN.

Today, we recieved an email notification from USCIS saying that .... "On December 31, 2007, we mailed you a notice that we have approved this I131 APPLICATION FOR USCIS TRAVEL DOCUMENT".

Question 1

Because we are planning back to China for celebate Chinese New Year on Feb. Does it mean she can travel aboard and then return to US along with this notice ?

Question 2

In very beginning, I am planning back to China with my wife for celebate the Chinese New Year in Feb. In the worst case, if her AP document is not arrived on times before our trip even it has already been approved on December 31, 2007. Do you think it is safe for her back to China by herself & I will join her after I receive her AP document.

You'll probably receive the AP within the next few days. Mine took a week from the notice date. The "notice" will not get her back into the country. She needs the AP. If her AP has not arrived by the time she leaves in February it is more than likely "lost" and you will need to take action to track it down. Yes, it is safe for you to join her after you receive it (providing it comes, of course) but you're probably worrying for nothing. Give it another week. You'll probably have it in your hands by then.

Definitely don't leave until you have the actual AP documents in hand. You will not be let back into the US with just that email approval.

Also, when you get AP, you'll get 2 identical papers. Most think you only need to take 1 with you to travel since they are identical, but you need to take BOTH. Some VJers have posted having problems and explaining themselves to immigration officers where the other AP paper is, and why not with them.

Thanks for all valuable advices ..... I hope we will recieve the AP document few days after we recieve the approval notice letter. It is nice for us back to our country celebating Chinese New Year with our relatives in Feb. By the way, Happy New Year 2008!
