I have one question im divorced im the petitioner for the DS-230 do I need my divorce decree to send in or not? Thanks

Yikes! I am divorced, and I did not send mine in!! THe only thing I saw was if the benificiary was divorced. On the instructions for the DS230 it says:

Applicants who have been previously married must submit evidence of the

termination of EACH prior marriage. Evidence must be in the form of

original documents issued by a competent authority, or certified copies

bearing the appropriate seal or stamp of the issuing authority.

Acceptable evidence is a:

• FINAL divorce decree

• Death certificate, or

• Annulment.

The reference is made to the beneficiary as seen in the introduction:

You have been registered with the National Visa Center (NVC) to apply for a

visa to immigrate to the United States. You must now obtain the documents

required for your application for an immigrant visa and send them to NVC.

From what I can see, it doesn't look like you would need to send yours in. Any other petitioners send their's in??

joyeann thats what I wasnt sure about. If they ment if my husband was divorced previsouly if I need to send one for him (he was never married before me). But I wasnt sure if they wanted mine or not. Thanks for your replies.

It was only asking for the beneficiary to supply the divorce decree for the DS-230 since it's the alien who is applying for the visa.

Yes you will need divorce decree at the time of interview in embassy however there is no need to submit divorce decree with DS230 at NVC.

Yep Yep I won't need the divorce decree until it is time for my hubby to go to his interview. Other than that the DS230 is regarding the Beneficiary, not the Petitioner. So I believe that basically anything that you submitted copies of since the process started, they will need the original at the time of the interview.

And hopefully that will be SOON for all of us!!

TwinCactus, the question was if they needed the divorce decree of the petitioner with the DS230 (nothing about the I-130) Therefor, the answer was no, they do not need the PETITIONER's Divorce decree. The DS230 instructions refer to the Beneficiary only.
