Does anyone know what will happen?

Timeline

Hi all

Long time since Ive been on VJ....I remember being so excited to see my now ex. Im wondering if you all can help me...yet again...get through a difficult time.

I filed for a divorce in Nov of 06. My husband came here in Jan of '05.

My husband came here on a CR-1 and was supposed to file for a 10 year greencard in Jan of 06. I told him since we were seperated, I couldnt lie to the government and sign for his visa.

He is *still* very upset about this....but while I was 6 months pregnant, I found out he had cheated on me with a few diferent women. The stress caused me to have our baby early resulting in our son weighing 2 lbs 15oz and needing 3 surgerys to date. Before we were even released from the hospital, my husband was back in his country, with one of the women he had been cheating with.

I went to the embassy and withdrew my petition for him.

Does anyone know what will happen with his status here?

12-14-04 NVC says cannot confirm fax received

12-16-04 NVC asks me to re-fax the W2

12-16-04 W2 re-faxed. TWO times.

12-17-04 NVC operator says fax receieved

12-21-04 NVC Updates phone message to say fax received.

12-22-04 CASE COMPLETED!!!

12-25-04 Flying to Jamaica to spend Christmas with hubby!

01-07-05 Picked up Medical Packet from KNG Embassy

01-12-05 Medical Scheduled/ Preformed

01-19-05 Interview at Kingston Embassy

01-21-05 Picked up CR-1 Visa at Embassy

01-24-05 Hubby and I flew home...TOGETHER!

By the way...Im not a lawyer. Neither is my spouse, my mother, my father...or anyone else in my family. But....My sister is a nurse, does that count for anything?

If he entered the country on a CR-1 visa Jan 05, the card is good for 2 years, so should file to remove conditions within 90 days of card expiration which should be Jan 07. Infact a spouse can file imediatly after a divorce is finalized and file a waiver to the joint filing requirement on the I-751.

To clarify, Is your ex-Husband now in the US or in his home country?

Before we were even released from the hospital, my husband was back in his country, with one of the women he had been cheating with.

I would contact USCIS and give them your side of the story, if you feel that he used you just to get green-card.

10 year GC Approved - APRIL 16th ,2009 - Peggy and Jonathan's......

Still waiting for our cards...Had to file I-90 as they sent them to the wrong address.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

This really makes no sense. The petition was approved a few years ago, and he received his visa. You cannot withdraw an approved petition as that is history. Furthermore the embassy has nothing to do with approval or withrawl of petitions...that is done by the USCIS. You cannot even withdraw your Aff. of Support. Getting divorced is not grounds to withdraw it...so Im at a total loss in trying to understand what you are saying.

If he did not file to remove conditions he will receive a letter from the USCIS telling him to leave the country.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.
