Hi, I am new to this place.

My wife is here in the US on H1-B researcher status. She just ahd it renewed till 2010. We married in August 07 here in the US.

This is what I believe I need to fill out:

1. I-130

2. G-325a

2. I-864

2. I-485

2. I-765 (optional)

2. I-131 (optional)

From what i read, seems like we need 2 certified copies of marriage certificate (1 for 130 and 1 for 485).

The last 2 are my real questions. 765 is if you want to work while application is processed. For her, this would be for work outside her H1-B? Is this necessary do you think? She will do her H1-B job for at least 1 year.

The I-131 is for travel. Since on H1-B, I believe she can travel outside the country and return. Is this a better travel certficate to have that H1-B?

I-485 indicates "A" based on the I-130 enclosed in the same envelope.

Send everything to the Chicago address indicated with form I-485.

Only 1 certified marriage cert needed, just make 2 photo copies of it and include with I-130 and I-485.

USCIS no longer routinely requires submission of original documents or "certified copies." Instead, ordinary legible photocopies of such documents (including naturalization certificates and alien registration cards) will be acceptable for initial filing and approval of petitions and applications.

File the I-765 with AOS it costs nothing when filed for with or after filing the I-485, if you file it after you will need I-485 NOA1 to attach to the I-765. Use (c )(6 ) Pending I-485.

I would file the I-131 too as stated above for the I-765, I-131 too costs nothing when filed with the I-485. I am not sure if filing the AOS may void the H-1B.
