Hello Naturalization awaiters:

I applied for my US Citizenship in April 2006 along with my wife. My wife got her citizenship in June 2006. I still haven't got my call yet. My fingerprint was done almost 18 months ago. After that I went to the USCIS Office in Newark NJ to follow up using an Info Pass. I was told that my papers were with FBI for name verification. After around 18 months of waiting and follow ups I am still being told that my papers were with FBI. What would you suggest me to do, please?

Seek qualified Legal help. If U document/papers are still with FBI, they is probable good reason. If u r Muslim or have Muslim sounding name, then reason it quite clear by US standards. If u r in US already, watch out u back. They probable have a tail. Just need to set Attorney right aways before they send u to Gitmo or somplace that u will need legal council but have no access to it. Fight back. Don't let them push u.

Well, this is a huge problem for Immigration and Naturalization and you are not alone in your waiting.

Recently the ACLU of Los Angeles has filed a suit against the head of the FBI and USCIS about the extreme delays in getting FBI name check clearance for citizenship cases.

Let's hope your case will benefit from this.

I'd contact your senators and House representative first, but it's probably true that your name made the hit list. (It's not just any Muslim name, it's names used by known terrorists, but since so many Muslim men's names are so similar, it's not surprising that a large number of people get a hit.) If you're *really* unlucky, you *also* share a birthday with the man whose name you share.

I'm glad to hear this. :thumbs: I think it is just ridiculous and totally unfair that in this computer age, it takes months and years for name check! :angry: I mean, everything can be checked out in a matter of seconds, right?! :blink:

I understand and agree with all that you have said. At this point I just need to wait I guess and see what happens. I know I am just being unlucky. Btw, I did contact both my senator and a house of Representative. They do just what I've been doing. Call up USCIS and tell me that the papers are with FBI. They diligently send me the same status from the past year and a half. :(

I really am surprised at some of the comments on this thread. Being delayed due to FBI namecheck can happen to anyone. its an unfortunate and ridiculous stumbling block, but no reason to think you will be sent to Gitmo :blink: .

I totally agree with you. I was equally surprised at some of the comments / advices I received myself.

Kennedy - some people are still having success with filing a Writ of Mandamus. In Dec 2006, for the most part, USCIS closed that loophole, however judges in more *blue* states are still hearing these cases (albeit it limited). Of course many are still thrown out, and you must have shown diligence and exhaustion of administrative remedies (ie: infopasses, service requests, rep.senatorial help) but if its a shot you are willing to take, there seem to be some shots left ;) (it's just not the sure thing it used to be).

Another option is to focus on lobbying, there was actually a partial victory in that "20 million set aside to fund name checks delays on

the condition that DHS produce a plan first". This is better than nothing! You can find out more about the lobbying effort HERE

Yes, I agree.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

my husbands name has be stuck in fbi for over 3 years now. anyone can get a hit on their name and at any stage of the process. all that can be done is just wait it out.

Thanks for writing back to me Donna. I came to know there are people that have their Name Check stuck for the past 4 years. I also heard that there are people who sued the INS and got things moving too. Thanks for the inputs.
