How long can a person stay in home country after getting k3 visa?

someone has told us abt 2 months is it correct?

what if a person crosses the time limit..

Does he has to apply from the beginning?

This is what I understand: Anyone is free to correct me,if I'm wrong.

The K3 and K4 is a 2-years Multiple Non- Immigrant Entry Visa. In my case my K3 & K4 visa were issued July 2006 and it expires July 2008( as written in my passport). So I only have 2 years to use my passport to go in and out of the US ( if needed for important reasons).We didnt leave right away but actually used the visa after 3 months.

If one intends not to use the K3 visa immediately and stay a while in her hometown , one should instead have just applied only for the immigrant visa, that way she can use the longer time that is entailed in waiting for that visa, as time spent staying in her home town. So if you did not use your K3 visa ,make sure you are still processing and minding your original I130 Immigrant Appilcation.Submit requirements,pay required fees and attend interviews,etc. If approved , you will be entering the US not as a K3 visa holder but as an immigrant already. Remember, applying for the Non Immigrant (K3) visa is optional after you applied for I130 Immigrant Application. So you dont have to start all over again for a k Visa.

Now if you leave your country before your K3 visa expires. (check your passport for expiration of your Visa), you dont have to wait for the Immigrant Visa in your country. Instead you would have to apply for Change of Status to become a Permanent resident once you are already in the US. In my case I applied after 2 months, some people do it earlier. I advise you to do it as soon as possible.

Yes. The Department is authorizing the issuance of ten-year multiple entry visas to K3 and K4 visa recipients, except in those instances in which the limitations of age (aging-out), security concerns or ineligibility waiver limitations indicate a shorter period of validity is necessary. A special visa application supplement for K3 and K4 applicants will also contain a notice informing them of the potential consequences of marriage by a child recipient of a K4 visa prior to admission to the United States or adjustment of status.
