Hi, every one! Happy new year!! Can anyone answer my question? My question is, is it OK to deny previous marriage and children on a K1 Visa application? My friend in the Philippines just got engaged. She has 4 children and was married. Now, since there is no divorce in the Philippines, Annulment papers hard to get. But, according to her, their civil marriage is not legit because her ex's birth date is not even right. She is confident that it will not matter. she was able to get a philippine passport with a single status and no problem. My concern is though is not she is not going to disclosed on the application that she has children and married before. I am worry about her and I told to find a legal advice. she said sought one and told her to go for it. Even told her to just adopt her kids later on. I don't think this is right either. So, please anybody I need some help here. It would be a great appreciation if anyone could help me here. Thank you

Tell her not to lie.

If they find out about it later, her visa WILL be revoked.

Whether or not you can deny the existence of a previous marriage is one thing, but how can she possibly deny the existence her children?

Convinced her to get an annulment first because she or they will waste time, effort and money for the processing and in the end she will be denied with the visa. The consulate will still find out of her previous marriage.

That is what I am trying to explain to her and to think of that legal advice she got. Very unbelievable! If annulment is not that hard to get it will be an easy process and that way she can declare that she has children.

Not doubting the veracity of your relationship, but do you really want to consider a life time committment to somone who: a) willfully will lie about their children or :b) does not understand the ramifications of such actions?

If she can obtain an authentic CENOMAR (Certificate of No Marriage), then go forward but be sure to include any minor children on the application. Otherwise, I believe she would be considered abandoning her children and subject to immediate deportation once discovered in the US.

I offer a prayer for your situation.

I dont think lying is even an option to take, its totally suicide. I'm sorry to be harsh. I just wanted to bring in a point. To go through the long process of getting an annulment, even if it means time and money ,etc spent and endured, it still is the only option. I went through it, everyone in the same situation went through it.

Dont risk losing everything by cutting corners. File for annulment, be honest. Your husband lying about his birthday or something will probably help you win your case faster. Take my advice, go through the process. I'm Filipina and I'm speaking from experience. I have the same complicated marriage "case" but there is a legal process that can straighten things out. And you will have no fears afterwards.

I think your friend is taking a huge gamble. Just because she doesnt consider the marriage legit and got her passport in a single status, does that mean she can get the CENOMAR? Why spend all the money and all the time just to be denied when she can't get the correct documents? But its her life and if its a chance she wants to take....
