DMV will only issue driving record going back 10 years

I definiatly would NOT answer yes unless you have all the records for the 3 convictions. Remember you can be arrested and not convicted in the courts. Can you remember?

If it was my form I would answer NO unless I could locate 3 conviction records. I'm innocent until they prove me guilty to the best of my knowlege.......................

If you answer yes this will not deny your petition. But they will want all the records.

If you research the background checks of the government and how it works it might make you rest a little more easy.

FWIW, some misdermeoner crimes do not show up on the Federal goverments background checks. In order for small, petty crimes to show up on the federal background check, the county which you were convicted must forward it to the state computers from which the state forwards it to the National data base. Thousands of records are not forwarded to the state unless they are deemed serious and in the nations best interest. In my county they do not forward some small crime convictions. If the FEDS want to know they have to contact the county or state and inquire about a persons record in question.

I know of people with Class C misdermeoners. Their record does not show up on national searches but it will show up if you go to the county and do the search at the courthouse.

I dont know if these people ever pick up a phone..........

You're not innocent if you've already been proven guilty but just can't remember and/or produce the records.

When it comes to immigration, I'd rather have the correct information on my form than to answer incorrectly based on a faulty memory or incomplete records. Get the records. Is it really worth losing the opportunity to be with a loved one because of these sorts of annoying but important issues? Not in my book. If you think of what your fiance is giving up to come here (like oh, everything) then it is worth doing a little hoop jumping up front to ensure the best outcome.

You're not innocent if you've already been proven guilty but just can't remember and/or produce the records.

I would not want the OP to lose the opportunity to to be with a loved one either. I think this is a delicate situation if the OP is being honest in his post.

Anything this man sends or admits must be supported by evidence or records. What will happen if he checks the yes box and can only produce records for 2 convictions? He is done!! They will want the records for the 3 convictions. He will have to start over. Remember for the USC, none of this will keep him from being denied. I dont know what will happen if they find 3 convictions and he checked the no box?? I think he is being honest and not lying if he checks no. In his mind he does not know. He could check yes and supply the 2 records along with an attachment about the 3rd conviction and that he cannot locate the records for that arrest. My thoughts will be... they will think he is trying to hide something and want the records. Then what?

This raises another question. If their background checks are so good they will find everything so they dont need him to provide anything . They will find it for him and then move forward with the petition.

10-25 years ago DUI laws were different. He could have been arrested for DUI 3 times but the records might show 2 times. It was more like a speeding ticket back then. He might search and search and never find the records because they never were there in the first place.

Only the OP knows the real story and I wish him luck. He can at least read different opinions and make the best choice with the info provided.

Again, he can do a freedom of information act request to get his complete records from the FBI and anyone else that might be able to tell him what they know about him. It will take time but there is no reason to guess or hope when he can do what he needs to do to make sure he appears honest on his paperwork.
