his dad is an american citizen, and my baby is turning 7 months old. we were not able to file up since i was pregnant when we are filing k3 visa however, when i give birth i-130 approve luckily so as per advise by the lawyer k3 will be cancelled and will pursue with CR1 visa (leaving the i-129f)

im in the process of sending the affidavit of support and fee bill since my choice of agent is my lawyer

what do you think i should do so i can bring her with me? and how can i apply her for birth certificate abroad thanks. happy new year. :help::innocent:

Who told you that you couldn't file when you where pregnant? That is a new one to me.

Provided that your spouse was a US citizen at the time of birth, the baby is entitled to US citizenship and will not need to enter under a visa. However, your husband must register your son's birth in person at the local US consulate.

Under some circumstances, such as the couple not being married at the time of the child's birth or if they suspect a fraudulent claim they may require DNA testing.

Is your husband US military or a civilian?

When my daughter was born- (dad is a US civilian) he called the consulate and they sent the forms to be filled out prior to us going to the consulate. Your husband must bring his proof of citizenship and proof of at least three years residency in the US, along with the baby's birth certificate and marriage certificate.

PS. I stand corrected- when I double checked, your spouse must provide 5 years of proof of US residency in total-2 years of which must be when he was 14 years old or older.

My daughter is A USC now and holding a passport becuase of her father, its easy too, when you have all the documents the USEM will ask you.

It also might be helpful to have airline ticket stubs or intinerary, or hotel receipts showing he was in the Philippines when you became pregnant. They also have the option of requiring a DNA test.

I think I can help you..

Me and my wife were in the same situation before. The only difference is I took care of my daughter's US Passport 1st before filling the Petition for my wife..

What You need to is have your spouse with you in the Philippines when registering for birth abroad and application of passport..

You can call the USEM to request the application, and they will send it to you via Air21 Express.. Fill it out, include the proof of father's American Citizenship then call USEM again for pickup..

After you send it wait for 2 weeks and they will call you guys for interview.. Have the proof of documents with you guys on the interview.. Upon the approval USEM will send the US Passport to your home..

IR-1 Visa for Wife

NVC Case Complete = January 2, 2008

Received Packet 4 here in the US (Interview Packet) = January 18, 2008

Case Left NVC Forwarded to USEM Manila = January 23, 2008

SLEC Medical = Jan 31 and Feb 1, 2008 (2 days)

I was in your situation and just gave birth to our son 9 weeks ago here in Germany while I am going through the visa process. My husband did not have to be here in Germany when I received our sons american passport and filed for a birth certificate abroad. Maybe it is different by country. Ours was very easy. Had to bring german birthcertificate...proof of my husbands us citizenship (certified birthcertificate) ..he had to fill out 2 forms that the consulat sent to him in the us and had to sign and fill them out there in front of a notary public and i took them to the consulat with proof that he has lived in the us more than 5 years since the age of 18 ....and my info...got our sons passport in the mail 2 weeks later...now we are just waiting for my visa...but we are almost there...

the birthcertificate aboad and american citizenship for our son was a very easy process

call the consulat in the philipines and ask what you need...it was better for me to talk to them personally...they told me on the phone he did not have to present in germany...on the website it said he had to
