Hello everyone! I am hoping someone can help answer some questions for me. My fiance and I are planning on marrying in Colombia in Feb of this year and then are going to begin the process of filing for him to come here to the states. We are thinking of pursuing the k-3 visa but would it be just as easy to file for the Cr-1?

Also I am preparing paperwork for the wedding.....since we do not have any proof here that I am single since I have never been married or divorced I have been getting letters from people I know. How many letters should I get?

After we are married I am going to be in Colombia for another 6 weeks. Is it alright that I send the I130 packet from there as long as I have everything? Any suggestions would be greatly appreciated!

Hello Ashley,

Going through Bogotá will be an easy process. The difference between K3 and CR1 visas is only about a month. With a K3, your spouse will get here about a month faster but then you will have to file for AOS and EAD if he wants to work and it will take between 3-6 months. With a CR1 visa he will get here a month later or so but he will receive his green card and social security # within weeks, without the hassle of having to file and for AOS.

And yes, you can send the I-130 from Colombia if you want to move things along as long as you have all the necessary documents.

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

On the US Govt. side, you need not prove you're single. So, just follow any requirements of the Columbia government office controlling marriage to a foreigner. Whatever it is, it is.
