I filed a I-130 4 months ago..now I feel that refiling both the 129-f and I-130 together and paying again..will that start the 129-f timeline..I have no idea when the I-130 will be receipted .and at least if this is accepted my timeline will start...anyone have any idea if they will expedite those people who have been waiting forever or will your timeline start on receipt of the 129-f ,,it just does not seem right to pay double or triple and then wait twice as long...the k-3 will take almost a yr now ,since i am in canada the ir1 is still over a yr ,,anyone know if the nyc will process those i-130 faster?

USCIS can take up to 6 months to approve a petition. Have you received notice of receipt for the I-130?

Refiling will not speed anything up.

Your profile says filed for K-1 yet you are talking K-3?

Lastly for most countries the CR-1 is taking only slightly longer than K-3, why not just stick with the I-130 that you have already filed? It results in CR-1 IMMIGRANT visa, this allows immediate work authorization due to receiving green-card upon entry to the USA. K-3 requires further filing for AOS to get green card, and filing for work permit which can take 90 days or more to get. AOS costs $1010.

Yes, as Dan said, it is difficult to understand your situation without the timeline and a correct profile. You said that you have not had your I130 receipted right?

According to USCIS, they have receipted I130 at CSC received on or before 8/30/2007 and at VSC its on or before 7/31/3007. See here: http://www.uscis.gov/portal/site/uscis/men...0004718190aRCRD

That means that if you filed later than these dates, you should expect an NOA1 sometime in the near future. If you file again, you will not get a receipt for some time for either the I129F or the I130 as they are still waaay behind in receipting. Your timeline for a K3 starts when they receive the I129F in the mailroom. You will not help yourself by sending the I130 again. If your check was cashed, you could use that as proof of having submitted the I130 and send in the I129F. If not, since you don't have the needed proof of a pending I130.

You could do as Dan said, and just hold tight and get the better CR1 visa, which might take a little longer but not much. Even if you send in the I129F after getting the I130 NOA1, it might end up not getting paired in time with the I130 to have any effect.

For Canada the IR1 will be a much longer wait..after approval Montreal takes many many months for an interview. I think waiting it out is probably the best option.

Oct. 17, 2011 Biometrics appointment

Thanks for the info..I am still waiting for the receipt for the I-130,montreal is horrible on both service and waiting..4 6o 6 months wait for interview and 6 months for the nvc to do their job..does anyone know if the nvc will use the postal receipt as the beginning of the timeline..then it would make sense as only another 2 months for nvc and 4 to 6 months for montreal...anyone have any ideas..or is it 6 months from the noa1
