Hi Guys,

I have noticed that most of you have sent I-130 and I-129F together. I sent my i-130 few days ago because in their web site it says I have to wait until I get NOA1 in order to file for I-129F. Did it change? Can I still file i-129 now?

I would really appreciate if someone could forward me the uscis newsletter that mentioned this new rule (filing together). I could not find it anywhere in their web site. It still says filing seperately.

There actually are no USCIS official instructions saying file the two petitions together. The basis for doing so comes from this press release and the success of those who have done so.

You see, before this release, I-129F for spouse petitions were all processed in Missouri, while the associated I-130s were processed at other service centers. Note the USCIS website says to send evidence of filing. One (the most popular) form of evidence is the NOA1. Any actual evidence is ok. What has been surmised is that since "evidence" is required AND the two petitions are now adjudicated not just at the same service center but TOGETHER, is that the I-130 in the envelope with the I-129F is the best possible evidence of filing, particularly now that the same fee covers both.

As to whether you can file now, what evidence do you have that you filed the I-130. Copies of both sides of your cashed check will do. You don't have to wait for NOA2 but you must have actual evidence of filing the I-130.

I haven't receive my NOA1 either for the I-130. I know that it has been received at the Chicago lockbox according to the USPS tracking in early December. However, the check has not been cashed. Waiting for the notification has been a frustrating month. I want to send my I-129F so I can kick start my K3. Can I still send it some how? I called the USCIS 800 number a couple weeks back and talked to someone and she said it will take a while to process the I-130. I asked if I can send the I-129F and she said that I have to wait to receive the NOA1 from my I-130 or they will return my I-120F back. I don't know what to do for fear that it may delay things even more. This whole process is extremely slow and painful!!

Marriage : 2007-11-24

I-130 Sent : 2007-12-10

I-130 NOA1 : 2008-02-04

I-129F Sent : 2008-02-08

I-129F NOA1 : 2008-02-11
