I waited till I recieved my NOA2 to send my I-129F in and it was returned to me saying:

"Our records indicate that your I-130 is no longer pending. The I-129F (K3) petition for your spouse can only be accepted by the Service Center if the underlying I-130 petition is currently pending"

There are no instructions on what to do or anything.... What now?????? :blink:

Not an expert here but does that mean that once your I-130 is approved then end of that story for the I-129f process? Hopefully senior members can jump on this one.........

Would be interested to learn about this tho.

6/26 NVC - RFE uggh - wants all three years of Federal tax return listed and they lost originals or so they say - DING DING ROUND TWO

7/25 NVC Case completed whooottttttttt

8/7 Case forward to US EMBASSY LONDON OH YEAHHHHHHHH -

Embassy - case out for delivery to embassy via DHL sneaky us lol

08/10Received

08/19 Medical Exam completed - healthy oh yeah!!!!!!!!

9/26 @8am -Interview - approved VISA IN HAND OMG WHOOT!!! HELLO AMERICA MY LUV

POE- Atlanta then MCO - October 15th with the cat "GIT" on board lol - POE SUPER SWEET

Husband home finally - god what a journey....but after 400+ days we made it

Yes, that's exactly what it means. You waited far too long to send the I-129F. Once the I-130 is approved, it's too late for a K3. The old rule of thumb for those wishing to go the K3 path was to send the I-130 once they received NOA1, not NOA2. Now the two petitions can be filed together.

Now what? Now you do nothing with your I-129F and you deal with NVC on your I-130.

Yes, that's exactly what it means. You waited far too long to send the I-129F. Once the I-130 is approved, it's too late for a K3. The old rule of thumb for those wishing to go the K3 path was to send the I-130 once they received NOA1, not NOA2. Now the two petitions can be filed together.

Now what? Now you do nothing with your I-129F and you deal with NVC on your I-130.

Are you stuck in CR1 filing now?

Did you clearly state with your I130 that you wanted a K3?

BTW I did 14 months in North Pole brrrrrrrrrrrrrrrr (laughing)

It doesn't matter what you say when you file the I-130. Only an I-129F can result in a K3. "Clearly Stating" an intention on an I-130 is for requesting Consular processing of the I-130, not the other way around. K3 is out of the question when an I-130 is already approved.

Hi Scott,

I'd say you are lucky in fact and that you should be moving on very fast shortly.

We were told to go the K-3 visa and found out it's not as fast as it used to be, not even mentioning the AOS fees.

We have been married for longer than you have and have filed before you have, and we are still waiting for an approvel on both I-130 and I-129F.

So lucky you jump on that opportunity and move on with the IR-1/CR-1 visa.

My husband works in Alaska as well, north of Fairbanks and used to live in North Pole where I visited him a few times.

I also like Anchorage and his home village/town of Talkeetna.

Hang in there and good luck on this path!

You are not that far from being approved Christine (if all goes well). Then, you will sail through NVC and get to the embassy well before Scott's I130, which will take 2-6 months at NVC. Who gets done quicker depends on how long it takes the embassies to schedule the K3 and CR1 interviews. K3s are usually still a little faster than CR1s, by a few months at least, and maybe more depending on interview scheduling differences between the two at some embassies. Depends on what is important to you in making the decision (speed, need to work right away, ability and willingness to pay AOS fees) all should have been considered in making the decision.

For all my Argentine friends, we recieved the visa today Friday 13th. The interview was a breeze but the waiting was horrible, almost two hours and they lost the attachment to the last paperwork but that was ok. We just put the infomation.....

The interview was about 10 questions very straight forward and easy to answer. The choice of spanish or english helped my wife very much even thought her english I think is very good. But she was more relaxed speaking spanish.

I want to put my timeline back on VJ but I am still very dissapointed with one of the members so if you want to know the whole timeline please email us at johndesofi at hotmail.
