Hello,

On my passport I still have my maidden name with my ex husband's name.

On my ID I have my maidden name with my new husband's name.

I asked my lawyer if it was aproblem and if I should have my passport redone before the interview, he said NO that the name on it didn't matter as long as my maidden name was showing...

Though I trust this man less than i'd trust a complete stranger... What do you think?

When I filed for the K-3 visa I gave my passport number and if I have it being changed then I'll have a new passort number.

What should I do?

12/04/08 Initial Interview appointment / Rescheduling requested

02/03/09 Interview appointment / very easy, very nice officer, not too many questions, our evidences were enough

02/03/09 Green Card granted for the four of us

02/16/09 Green Cards arrived in the mail

We discussed that with the consul. He said that in their case the visa is granted in the name that is on the passport. Nit had her passport modified (there is a page for the immigration office in her country to make "official" changes) to show her new name and had it stamped by the immigration official there.

We sort of knew what to do because one of my wife's friends is married to a friend of mine here and came on K1, had to get her passport changed at the Indo consulate here before AOS.

Our choices were:

File the petition in maiden name, have names all match and do name change at indo consulate then file AOS in new name

File the petition in married name and do name change in passport at Indo immigration before interview

We took #2 because it was easiest to get all of the ID documents, etc here in the correct (married) name.

I'm sorry, but your "lawyer" is an idiot.

The best practice is for your passport, petition and visa application to reflect your current legal name. Since you have ID in your new married name, I'm going to conclude that your legal name changed at marriage. (This is not always or automatically the case.) So, I would advise you to either get a new passport or have the name changed in your passport, whichever is most appropriate for your country. It varies.
