Does applying for the visa lottery count against you?

Hello, all. I had forgotten all about this until today. My husband applied for the visa lottery in 2005 on a lark before telling me. He was chosen to go forward, but didnt follow through. We totally spaced this and didnt mention it on any of our visa paperwork. Now I wonder if it will count against us at Casa. I don't even know what goes into applying to be considered, so I'm not sure how significant it is. We're estimating he'll get an interview date in March.

Any ideas as to if this would negatively affect our chances with Casa and what we should do about it? Thanks!

From what I've seen on VJ, it shouldn't be a problem. The only thing is that question about ever having applied for a visa before - I can't remember if that comes up in the petition or later on down the line in the paperwork for the consulate. I hope he hasn't answered "no" to that question on any documents he's submitted.

I went back to look on all the forms we've sent, and there was a question for me asking if I'd ever sponsored another immigrant. I answered yes because my first husband was an import, too. But, I didn't see anything asking if he had applied for another visa. We're doing CR-1; if anyone remembers something I missed about the forms, please let me know.

GEG, I could be wrong here, but I do not think that applying for or even "winning" the lottery qualifies as applying for a visa. It just gives you a basis on which to apply for a visa. If he never went forward with it as you post, I would guess he never applied for a visa. Splitting hairs, perhaps...

I took a quick look, and I think you're ok too. It's on the DS-156 for non-immigrant visas where they ask if you have ever been issued or refused a U.S. visa before, but as a CR-1 you wouldn't need to fill this out anyway. And like jpaula said, winning the lottery might not even be enough to have to disclose it anyway.

I agree with this poster.

My fiance had applied but not won the lottery and it was never an issue. He did not put down the DV lottery only the tourist visa he applied for.
