Hi all. I have my AOS interview in February in Orlando, but things have changed a bit since we started the process, this is in reference to my husband's work situation. When we started he was working fullt-time, but now he is in law school. He still does some consulting work for the company. He has loans etc, that cover tuition and living expense as well - and he is of course still my sponsor.

What should we do? Will this jeapordize my application? Should we bring loan information as well as W2 information?

Before and after getting married, I was here working on my H1 and I stopped when we moved to Orlando a month after the wedding, so we had savings too. Should we have proof of this a well?

09/28/2007 Received biometrics appointment letter for Fort Lauderdale appt for 10/11/07

10/05/2007 Did biometrics in Orlando

11/9/2007 EAD approved

11/23/2007 Received EAD in the mail

12/14/2007 Advance Parole received in the mail

02/20/2008 Interview for AOS in Orlando

02/25/2008 Greencard Approved

March - got greencard in the mail!

December 2009 - Sent in Removal of Condition papers

February 2010 -Biometrics

March 2010- Received new greencard in mail

11/20/2010 - sent in N400 forms

12/21/2010 -did biometrics in Washington DC (really easy)

02/03/2011 - Appointment for Interview - passed exam but the officer said more information was needed and they would send me a letter. Still no letter received :(

5/10/2011 - Received note to appear for oath ceremony on 5/14/2011 (I guess no additional information was needed afterall :))

5/14/2011 - Oath ceremony (it was 3 hours long). Got certificate . . . YAY!!!!

Loans are not income. Does your husband still qualify as sponsor?

As long as you meet the guidlines set forth on the I-864 you are ok. If not then he should hold off on school until after the interview.

Thanks for the suggestions. He is already in school, so there is no putting it off. I think his part time income and summer work should cover the requirements. The interview is in February, so his tax forms will be from 2004-2006.

We'll think of something.

OK, so I went back to look at stuff and the requirements are 125% of the poverty line which is a total of $16,500 a year. I think he will make that with his part-timejob.

I will let you guys know what will happen.

What's strange is that you were no rfe'd on your I-864. The requirement is that you meet the relevant poverty level for you household, and that the income will continue from the same source (unless the wording has changed since we went though the process) the income can come from either party - it's the household income. If there is a problem, you will have to get a joint sponsor. If past income (most recent W2) does not qualify, then they will consider assets and present income.

What's strange is that you were no rfe'd on your I-864. Well they wouldn't ask for one because we met the requirement when we applied. I spoke to my hubby and he said he is in the clear so we are good, his consulting work will clear the requirement.

i thought you dont have to offer another affidavit once you applied for aos? do they want to see up toi date info for the affidavit at the time of the interview?

You can see from my signature when we applied, and when we interviewed. At our interview they required up-to-date pay stubs.
