We filed everything in november and they received it nov 30. Two weeks later we received a letter titled "Request for Initial Evidence (I-485). They were asking for federal tax info for the most recent year. We had already submitted it in the form of a letter we had sent to us from the IRS, but it seems they were wanting physical W-2s.

Here's the question though. On this yellow colored letter that i just described above, "Request for Initial Evidence (I-485)" the second paragraph said this; "You are in for interim employment authorization pursuant to Title 8, Code of Federal Regulations, Section 103.2(b)(10)(ii) until after ninety (90) days after the missing initial evidence is received."

Yikes. These 90 days would go past the point in time which my wife could work at her job while working with her EAD (OPT).

So, naturally we fired off the missing evidence (which was never missing, which we stated in a cover letter) 3 days later. We received an e-mail response from the USCIS 3 days later saying that our case had resumed.

Has anybody out there had experience with a yellow letter of this kind? Does anybody out there know anything more about this 90 day ineligibility for employment and how much the USCIS adheres to that?

We got the same thing, but a pink colored form. RFE for joint sponsor to send in current W2. We did not send it with the initial package. Our letter said the same thing about the EAD, but from what I gathered after calling them, they said the only thing that was delayed was AOS. Although my husband is still waiting for his EAD card and has had to stop working, as far as uscis time frames go, ours is processing normally. Hope this helps.

Same here, mine was not yellow but pink. They will start processing your case again once you submit what they were asking for. My EAD was approved 79 days after filing AOS, so the RFE did not really slow us down at all.
