In modern English and European systems of jurisprudence and law, a right is the legal or moral entitlement to do or refrain from doing something or to obtain or refrain from obtaining an action, thing or recognition in civil society. Compare with duty, referring to behaviour that is expected or required of the citizen, and with privilege, referring to something that can be conferred and revoked.

A privilege—etymologically "private law" or law relating to a specific individual—is a special entitlement or immunity granted by a government or other authority to a restricted group, either by birth or on a conditional basis. A privilege can be revoked in some cases. In modern democracies, a privilege is conditional and granted only after birth. By contrast, a right is an inherent, irrevocable entitlement held by all citizens or all human beings from birth. Miscellaneous privileges, e.g. the old common law privilege to title deeds, may still exist, though of little relevance today.

After seeing some of the other timelines I have had the same thought of why they just don’t take them to court. Well for one they probable would sit in court for a long time and spend way too much money. Then if they did "win" it would probable delay the visa process until after the court battle.

So I don’t know about taking the gov. to court would be a good idea, but an organized rally might do the trick.

Also important to note that we, the USCs, are not actually applying for a visa. Our SOs are, and their rights in this process are basically nonexistant as the constitutional or civil rights (due process etc) that we often take for granted and appeal to are in fact granted by virtue of citizenship.

Also, I have seen the USC try to sue, claiming their civil rights have been violated and it was flat out denied.

But, I do think the system needs reforming and we should all be lobbying for a more efficient, transparent process.

its not a good idea at all to get them to court,

as i read it not a civil right , and courts cant help so much hear but instead can delay

but i dont say there is no what we can do,

as a matter of fact the delay after the interview varies from one contry to another, like its not the same in canada as its in Egypt , i can count soem reasons , like fraud,differances between cultures, and sure the economic matters. and they need to be sure of the validity of the relation.

so i suggest to run it in friendly way and let them know its diffently not fair to put the worst stress on a relation aka (Waiting), and they are allowed to get sure of the vailidty of the relation by any other way but not this

so i bet it can be afficient that couples from each country contact the embassy directly through united complaint include every couple's signature, or something like that let them feel that this delay is really un- affordable for those couple who has their cases through this certain embassy

The consulate is untouchable, so there is no way to sue them. The USCIS can be sued, but in most cases the problems we have stem from the consulates. Unfortunately the power has gone to their head in some consulates. In other consulates its a matter of laziness. They don't want to do the job so they just send it back to the USCIS with flimsy excuses and out and out lies.

It may be a privilege, but unfortunately it is a fine line between the privilege of the applicant and the right of the citizen. I have had my rights crossed too many times by them. The lack of respect, the lack of honesty. Its despicable.

Sorry to say but you can't fight the system through a court.

Is it possible for all of us who have been waiting for visas to go to court to get our visas? Does anyone want to join together with me? Maybe if we all stand together and take legal action we can make a difference.

I have heard from attorneys that it's a waste of time and money.They always end up covering their backsides and winning.

May 7,2007-USCIS received I-129f
July 24,2007-NOA1 was received
April 21,2008-K-1 visa denied.
June 3,2008-waiver filed at US Consalate in Panama
The interview went well,they told him it will take another 6 months for them to adjudicate the waiver
March 3,2009-US Consulate claims they have no record of our December visit,nor Manuel's interview
March 27,2009-Manuel returned to the consulate for another interrogation(because they forgot about December's interview),and they were really rude !
April 3,2009-US Counsalate asks for more court documents that no longer exist !
June 1,2009-Manuel and I go back to the US consalate AGAIN to give them a letter from the court in Colon along with documents I already gave them last year.I was surprised to see they had two thick files for his case !


June 15,2010-They called Manuel in to take his fingerprints again,still no decision on his case!
June 22,2010-WAIVER APPROVED at 5:00pm
July 19,2010-VISA IN MANUELITO'S HAND at 3:15pm!
July 25,2010-Manuelito arrives at 9:35pm at Logan Intn'l Airport,Boston,MA
August 5,2010-FINALLY MARRIED!!!!!!!!!!!!
August 23,2010-Filed for AOS at the International Institute of RI $1400!
December 23,2010-Work authorization received.
January 12,2011-RFE

Exactly, the delays and waiting and mistakes are bad enough. But they won't even tell us where our applications are, why they're being delayed, or how long we can expect to wait. Or if they do tell us, it's a lie. It's not like this happens every once in a while, it happens ROUTINELY, especially in Egypt. If they would just make the process more clear to us and let us know what's going on it might make us feel a lot better. I don't know if lawsuits are the way to go, maybe pressure on our senators/congressmen?

They consolidated my 2 cases fiance and immigration into 1 case now and I called the NVC center and they said theyre backed up and it could take 3-6 months MORE to see my husband. Of course its a large estimate but DAMN! Im thinking about traveling back home maybe you shoudl travel back to be with your spouse but the worries about work money etc.. I don't have that thank god at the moment but I do feel for those who do have that! :angry:
