Can we all take them to court?

Also, I left my job, my studies, my family, to come here and take my husband home with me and I was under the impression that it wouldn't take as long as applying from the US. If you had done the same, maybe you would understand why it means so much to me. I didn't do all of that to just to find out that my husband and I have to wait just as long as everyone who applied from the US.

Maybe it should take you longer because you get the privilege of being with your husband while you go through the process.

I really took E & M's post to mean they decided to do DCF which does result in a shorter timeline often and not to mean that she feels entitled to a short wait. I guess I am not understanding your comment HannahP.

Oh, I read it as she feels entitled to skip the line because she dropped everything to move to Egypt. My bad. :er:

The process of the Writ of Mandamus itself can take up to 2 years, so even if it would be a favorable outcome it takes longer than

the approval itself.

Only in very extreme cases will it be a positive outcome and at a hefty lawyers fee.

There is nothing you can do except a congressional inquiry if your case drags on and on. However this just brings the case up from wherever

it happens to be to get looked at so an answer can be given to the senator / congressman's aide. It does not mean your time will be shorter.

Especially if security checks are done there is absolutely nothing that can be done.

The time you have invested before the petition was filed is of no concern to USCIS whatsoever, neither is your financial loss you have incurred

by opting to go that route.

My stats :

Third Christmas away from my fiance......one year in AP, unnecessary and forced DNA request , unreasonable DNA collection location in another country, second interview appointment April 2008 ( 5 months away after DNA results, back in the bottom pile ) 2 year process,.....flights to another country 3 times because no consular in fiance's country....... $ 10,000 and many hissy fits later ...... need I go on ?

If your husband gets here in under a year count yourself blessed.

just sitting and waiting for the embassy's kindness and mercy, i have been waiting for 2 years, I don't even have work, and I can't even go out of my country because the embassy has my passport. I'm sure that there is something we can do. The Diversity Lottery visa takes less than one year.

Can't we all together send a complaint to the government and tell them that the embassy put our papers on a desk, that they haven't even looked at them, that they lied to us? Maybe a petition or something? Would anyone be interested in that?

I just realized by your signature that you already had your interview.

How fortunate you are.

If security checks are done currently it is out of the CO's hands and even they won't know the time. They give an estimate, each

security check can be different from someone else's and there can be several ordered after an interview.

I don't think you were lied to, there is no gain for the CO to lie, it was an estimate that may be off weeks or months and out of the CO's control.

Your time table is running along just fine for now so chill and relax a bit.

You know, every so often someone will come on here and state that the CO told their spouse/fiance that they'd get their visa in two weeks/three weeks/one month, etc. I cringe when I read it because I know in my heart that although there's a teensy chance that it could be right, there's more of a chance that it is going to be at least 5 months or more. It's hard because if I respond not to get your hopes up then I feel like I'm popping a baloon of hope but then when the time expires and the person is shocked that it didn't happen yet I kick myself for not chiming in during that all too familiar hopeful stage.

Cairo is famous for doing this and I don't know why. We've had threads on this in the past. If they know there's no admin processing to be done sure go ahead and tell the candidate that they'll have their visa in a week or two but if there is admin processing to be done for pete's sakes just say it could be up to a year or even longer so that we don't hang on to false hope you know?

A lawsuit/complaints............I really doubt they'll do much at all. My senator and congressman's office wasn't too interested in pursuing the complaint that I had. Never even commented on it as a matter of fact. Who are these consulates answering to in the end? I guess that is the question that I'd like to know since it's certainly not the senators and congressmen since they get about as much info out of these people as I did and I'm just me. Who cuts their paychecks and who funds them? That's who to write to and even that probably won't do much good at all. As someone said before we have NO rights when it comes to bringing out spouses over here. I'm not sure if that's 100% accurate but it seems pretty much so since that's how we're treated. Maybe talk to a lawyer and ask them what rights you have. See what they say and then let us know. I don't think they'll have much to say though. It just plain sucks lemons.

The only public slap is for you. What is your purpose here? Who are you anyway slandering me and my husband on this board? I hope to God you are suspended immediately for the other post because if not then I have lost ALL hope for this site in terms of support for people actually going through the visa process. Sure I had hope that he'd get the visa in a month or two as they had stated but not just because they had stated it but because another member who had the exact same situation as I had DID get the visa in 5 weeks and it was right around the time I had stated this. Was I wrong? For sure, but kicking someone when they're 5 months into AP is a big no no on this board. You are a dispcicable contentious human being.

Just because bringing a spouse to the US is a privilege doesn't mean we don't have the right to expect some transparency in the process. For instance, the right to vote is a privilege. Not everyone is afforded this privilege (for example, in some states convicted felons are denied the right to vote). The process for registering to vote and who is allowed to do so is straightforward and transparent, and anyone denied this right may appeal. Although this example is clearly more simplistic than immigration, the point is that, in immigration, there is absolutely no transparency. We don't know what the process is, we don't know why applications are delayed or denied, and we have no recourse other than waiting for the application to be approved or denied. This is what I see as problematic. As citizens, I think we at least have the right to know what's going on.

Just because bringing a spouse to the US is a privilege doesn't mean we don't have the right to expect some transparency in the process. For instance, the right to vote is a privilege. Not everyone is afforded this privilege (for example, in some states convicted felons are denied the right to vote). OK, so what's the difference between a "right" and a "privilege"? Anything that can be granted or taken away is a privilege as far as I know.
