Can we all take them to court?

Timeline

Is it possible for all of us who have been waiting for visas to go to court to get our visas? Does anyone want to join together with me? Maybe if we all stand together and take legal action we can make a difference.

We've been waiting for nine months total. I had to live in Egypt for six months before I was allowed to even apply for the visa. Look at our situation before asking why.

I do know that and you saw replys you got from others on the wait they were also having, no its not fair but people before us and im sure people after us will continue to fight this. We all hope the immigration systems gets a "fix" for the best cutting all these times but for now this is what we have.

I saw how long others are having to wait and that's why I posted. I'm not just doing this for selfish reasons. That's why I asked if anyone wanted to join me. It's an unfair system and it's not going to change unless someone does something about it. I can't just sit back and wait for something to happen; I can't just let the embassy have control over my life and lie to my face. I know they don't care about any of the people who apply for visas.

Also, I left my job, my studies, my family, to come here and take my husband home with me and I was under the impression that it wouldn't take as long as applying from the US. If you had done the same, maybe you would understand why it means so much to me. I didn't do all of that to just to find out that my husband and I have to wait just as long as everyone who applied from the US.

No thats true i didnt move there but it does mean just as much to me. Our visa was returned (for what reason) we were given none and still havent been given one. Now if u ask for the denial letter so we can move on they say BUT ITS NOT DENIED ITS (EXPIRED) so you are free to refile and (pay the fee again) of course. So i did go there and we did marry now to refile which im sure will take no less than another year, so i know, and i agree i wish there were something that could be done, im just afraid no one will listen.

I'm sorry for what you've had to go through. See, it's cases just like yours that make me think something has to be done. And maybe if we all made enough noise about it someone would listen. And if not then at least we would have made an effort and maybe helped ease the way for others in the future. I don't even know if we have any legal options at all, but I have to find out.

One thing that I think you all are forgetting (and a judge would quickly remind you) is that none of us has a right to bring our SO here. It is a privelage. So you can get fed up all you want, and I agree the system does need to be reformed but when it comes down to it there is nothing that says "As a citizen of the US you have the right to marry and bring whoever you want to this country in an expedient manner." You have the right to get married to who you want but they have the right to refuse entry to whoever they want that is not a citizen. Sorry to be the humbug but that's the truth of the matter.

Maybe it should take you longer because you get the privilege of being with your husband while you go through the process.

I really took E & M's post to mean they decided to do DCF which does result in a shorter timeline often and not to mean that she feels entitled to a short wait. I guess I am not understanding your comment HannahP.

We've actually had the local CIS office LIE to us about having sent my husband's application to the NVC. It was our Congress Rep who caught them and you know what we were told by our U.S. Rep....."Sure you can file a complaint, but I would wait until after you are complete with the application as not to cause any problems".

Ummm, that was almost four years ago.

I've written letters and emails to every Senator, Department of State, Homeland Security official and even the President of the United States and I have yet to get any response. We were in AP for over a year and many of the delays have been because paperwork has been lost in the hands of this Immigration System.

Also, let me caution you about the "Writ of Mandamus", I at one time also considered filing this but was strongly cautioned against it by our own attorney. He says these cases are VERY, VERY hard to win. Unless you have substantial proof that an application was willfully mishandled by CIS or a Consulate, these cases rarely end with a decision FOR the plantiff. And some applications have been on a fast track to denial when going through this process. I have yet to hear of a current case that has done this and won.

Let me tell you, i have gone through the birth of our son without my husband and the sudden death of my father without my husband. This hardship of being a single mom going through this process does not mean anything to the power's that be either. I hate to be so negative, but many of us here have been dealing with this system for alot longer than you and we've found that there is nothing you can do but wait and hope that it's your day for good luck!

If you read many of the Consulate and government websites dealing with Immigration, they all talk about the amount of applications that have doubled since this time last year. No judge is going to listen to us about having to wait.
