Hello all,

I have been asking for advice several times here and a lot of you have been so helpfull.

Our lawyer never did anything right for us making us lose months and months in the process.

Each and everytime we ask him a question he gets upset and if we ask anything that has not been written in the agreement he tells us we have to pay more if we want his services.

We were asked $1,500 to start the process and will be asked $1,500 after I get to the U.S.A.

I have three children and just found out he might also have screwed them up on the immigration application, we are looking into it. He denises all the mistakes he makes because he is "an immigration specialists and knows what he does".

There are a few things on the agrement that have not been respected like him saying the process will take 8 months at the maximum but that he sill do his best to make it shorter etc... Well we have the 8 months since we hired him last April.

I don't know if we can tell him we don't want to work with him anymore and not pay the remaining $1,500 or if we can't.

Does anyone have any kind of legal advice for us?

Have you tried calling the USCIS regarding your petitions because I see your cases are still pending. I know the USCIS is backlogged. Sometimes, you gotta do things yourself and call the USCIS. Just hang in there.

But, I donno about the lawyer issue, it's your decsion =)

looks with all the updates it wont be long before you get word on case usally when you get alot of touches they are working on it or someone is calling alot to find out whats happening ??? not to get your hopes up sorry but this is just what i have read with other post on here good luck as for attorney yes thats up tto you but if i had one that gave me attitude and didnt do what i wanted just remember he works for you he is your employee sorta speak you call the shots and you can remind him of that he dont like it you can tell him he if free to quit any time and now you are armed with knowledge for your vj family you have an idea on what is going on more then you did when you started

Regarding your decision to keep your lawyer:

I don't believe for one second that a lawyer can "speed up" the immigration process for a family-based immigration. The USCIS and NVC and embassies process cases on a first-come, first-serve basis. There's nothing that a lawyer can do about that. This is my opinion: if a lawyer tells you that they can speed up your case, then run run run away.

Now, what a lawyer may be able to do is avoid typical RFE pitfalls (i.e. a missed document here, a N/A there etc) that will cost you time. Because hopefully they'll have processed enough cases to know how to prepare a thorough submission package. If your case is complex, and it sounds like it may be with you and your children immigrating, then having an experienced lawyer may be a good investment. However, it sounds like you are unhappy with your lawyer and that they may have not honored your contract. Reexamine the terms on your contract. If you believe that is the lawyer hasn't met the conditions, see another lawyer (a tort lawyer) to see if you can get out of your contract with your current lawyer and maybe get some of your money back. Then, from there...decide if you need another lawyer.

I have had many problems with my lawyer, but he has admitted to his faults. He had an incompetent assistant that he did not follow up on. I do not want to beat a dead horse, because it is counter productive. I found VJ.com when I was trying to figure out what he was doing wrong with our case. I now know the whole process better then him and his new assistant.

He offered to refund a small amount of money back. I told him it was a slap in the face and demanded more. I am sure he is waiting to see if our K3 is going through before we come to an agreement.

I will be patient. I hope you have copies of all your documents you submitted to him. I have every communication I have had with the lawyer via email. You can do this process on your own. As you can see the lawyer cannot get anything done any faster then someone who does it one there own. Matter affect it takes the lawyer longer because he is working on several cases. They can make mistake just as we might if we did it on our own.

Sorry to hear this but it is typical for lawyers to promise the world and deliver you just a small piece of a city. Did he or she actually put down in the contract the 8 month timeframe? That would be the key. Otherwise, most say that timeframe but as well know from this great site, and being pro active that it is not.

Its your call, but what I have done and ours is good to a point, I let them make sure all doc's were in order, and then I was the one that made each call and researched what was going on. I was prepared to do this anyways, because it is my style.

Finding a new lawyer if you need one that is, will be another chip out of your pocketbook, but that is entirely up to you. If he is that rude, suggest to him that if things are out of order with the paperwork or written promises, you can file a complaint with the bar, they dont take litely to that suggestion, but no money is compensated for this, just a smack on the face or if he has other complaints, sometimes they can suspend him. You can check his track record through numerous ways, one being going to www.crimetime.com and clicking on your state and checking status of lawyers/attorneys. Most will link you to Martindell for reference tho, but its early in the am for me.

Remember this man has the future in his hands. I would not make any threats or through out any harsh words until the case is put back in your hands. You would have to write a letter, maybe certified/notarized that he no long represents you. I am at the NVC process. We had already filled appointment. To change it I would have to resubmit.

My lawyer used to have time frames on his website. He has since taken them down. Smart man.

Yes on the threats will get you no where but you can check out his track record and if this is a common practice, hmmm......would not want others to experience this type of misrepresentation - but again, having dealt with lawyers/attorneys for so long now, they do not like to see those letters come in from the Bar Association. But you must have strong proof of his negilence and if his words were estimated timeframe, then thats all it was. Estimated. For an attorney to guarnatee you a certain amount of time for this process?????? wow, crystal ball with that one.

Thank you all very much for your advice.

It looks like we have no choice but to finish with him because of the contract we have and we all know how difficilt it is to prove a lawyer is wrong.

Anyways we have learnt our lesson and will handle things ourselves for the AOS. We asked him a question about it and he told us he was not paid for this part so he won't give us advice...

O saw that a lot of you who have applied for CR-1 are already approved and so more further in the process. I can't beleive this idiot made us take the longest and most expensive route again. I'm really disgusted at lawyers and USCIS now...

As for your contract, I wonder if you can prove that your lawyer did misrepresent his part on the contract then you may be able to get out of the contract. If you or your husband is near a large university with a law school, the law students usually have what is called a "law clinic" where they offer free advice. Bear in mind that the student are NOT lawyers and you will want to consult with another lawyer. But they should get you going in the right direction. And, check with your local church- they usually have a list of free legal services. It shouldn't be too difficult to get your contract reviewed by another lawyer.

Yes, we chose the CR1 route for several reasons. The main one being that we wanted to avoid AOS, and the timeline for a CR1 vs. a K3 was only slightly longer when we started our process.

I would not use a lawyer again. I'm supposed to meet with mine the week of the 7th. After he assured me that he would take personal care of my case after he screwed it up in September, I haven't heard from him once. I'm going to do my best to drive as much business away from that idiot as I possibly can when this is over.

Eric and Corinna, I checked your timeline and we are almost on the same boat... I completely feel your frustration about the lawyer, ours screwed us up as well and sent our I-129F two months late! We had to get angry.

He keeps e-mailing us telling us how much more he should charge us for such or such thing he's done, ... He is not going to get one more cent from us.

From everything I have read here only lawyers seem to make mistakes in the process and that's only because they get paid before and aren't concerned about what we go through.

We should make a chart with the names of the screwers here on VJ to allow others to consult it before paying anything! I'm jokking though it could be helpfull for others...

Our lawyer is not one of the best as well he is very good in charging for anything he does or pretend to be doing so I think it is a great idea to make a list of "bad" lawers to help other members to avoid paying for nothingto those who has o idea what to do
