I've noticed that several people have been able to get their permit/license shortly after recieving their SSN. We have been refused several times due to inadequacy of her Primary ID. They are wanting an UNEXPIRED I94 that has been issued for at least 1 YEAR. It falls under the migrant worker part. Or, we can come up with her green card/EAD (which we just applied for and looks like it will be 3months + before we recieve it.) I've tried to find the policy that DPS has for K1 visa holders, but I have been unsuccessful. So, PLEASE!! share the secret! She has never had a driver's license before in any country and needs to start learning soon.

You may have read of many people able to get driver's license with various levels of immigrations status, and SSN, but keep in mind Driver's privileges are NOT federal (US Government), they are granted by the states, so requirements can vary greatly from state to state.

For Texas the requirements are SSN, and EAD or Green-card.

EAD, then SSN, I concur with the previous answer.

HOWEVER, there is no reason she cannot get started by enrolling in a school/drivers ed course - we're looking forward to the entertainment actually while we wait. We have the same issues that you do, we will have to wait a few weeks before we can visit DPS

Welcome to my world... :( sigh

Some people had luck going first for a state ID and then applying for a driver's license with that ID. I tried 3 different offices with the same answer: no id until you have EAD/ green card. I think they might have tighten the rules on the past few months on this issue.

I know how it feels being in an area where you really need a car and you can't get your license :(

It appears that several of us have had issues with this. I just got off the phone with DPS (on hold for 22 minutes) and they told me that all I could do was call the Sargeant of that office and try to convince them to allow the NAO1 that shows we have applied for it. They also told me that Legislation decided those ID rules. They were very polite, unlike the office itself. I believe that they overlooked the K-status with all its differences. Anyone have suggestions for a Form letter we all can send and see if they will change it for our followers? I would be glad to post one, but I never did well in English or any of the writing classes. Perhaps we can even write a generic one in case any of the other states are having similar problems. Maybe even post it in the guides or example forms area. Any other suggestions?

A marriage certificate is considered "supporting evidence". To be issued a DL you need ->

one piece of primary identification; or

one piece of secondary identification plus two pieces of support identification; or

two pieces of secondary identification.

Go get a state ID asap... wait 2 weeks and return with the state ID and SSN and get the D/L

December 12 2006 Filed I130

Jan 10 2007 got receipt and case number!

Jan 12 2007 sent 129F

Feb 6 notice they were moving the file to a faster service center.

Feb 26 Notice of I130 approval

Feb 28 2007 notice they were sending 129F to USCIS for further investigation (err #######?)

May 15 2007 notice of approval of 129F with processing dates of 05/15/2007 thru 09/14/2007

May 28 2007 Notice from attorney that NVC needed processed and money orders were needed.

June 4 2007 Traveled to Manila to spend 2 weeks with my wife!! (YeHaaaa!!)

Fed-xed her signed papers (For NVC) from Manila to attorney from Manila while on vacation

June 18 2007 Nvc approved support.

June 29 2007 packet arrived @ my home informing of interveiw for I130 on Aug 27 2007 and explaining Medical interveiw.

(Note wife never received packet for I130 in Philippines I fed-ex'ed mine to her for medical interveiw)

July 17 2007 packet arrived for 129F setting interveiw for Sept 5 2007

August 5 2007 Wife flew to Manila for medical interveiw on August 6.

August 26 wife flew to Manila for I130 interveiw on August 27 2007.

August 27 2007 12:31 pm I130 Approved

wife arriving Nov 18th

WIFE ARRIVED Nov 18th!!!!

One would think. But it's not :(

I had my SSN, passport with K1 visa, unexpired I-94, marriage certificate, AOS NOA1, car insurance with my name, and I was still denied an ID. I have the feeling they may have become more strict in the past few months.

Are you a US citizen or a permanent resident?

You shouldn't...when I moved to Florida (and most states do this) my valid NYS driver's license was proof of ID and proof of knowing how to drive. :lol:

To enroll in drivers ed, you need a learner's permit, which has the same ID requierments as a drivers license and state ID.

I'm the bad news bearer of this thread :(
