Hi all,

I just got a package from the embassy for the K-3 visa. It says on their instructions page:

For Petitioner: Complete the original Form I-134, Affidavit of

Support and its supplemental documents: W-2 and 1040 tax forms (for the last taxable year), bank and other financial statements and forward it to your relative. (if you are not qualified to sponsor your relative financially, you must find a co-sponsor who can present a Notarized Form I-134 and supplemental documents in addition to your Affidavit of Support. Also you must prepare a statement explaining why you did not pay any taxes to the U.S. Government during the last taxable year).

So i got 4 questions:

- The Exp. Date is 04-30-07. Would that possibly be a problem to fill out this form? Or do we need to get an updated one? If so, where? Cause we can't find an updated one.

- About the co-sponsor: We cannot see any additional forms attached to the I-134. Do we need to fill out 2 seperate I-134 forms? (My wife and our co-sponsor)

- My wife got her IRS form. Can we use that as W-2 and 1040 tax return forms?

- Is it strongly recommended to get past 3 years tax returns or the last years is enough?

Just use the most recent one from the USCIS website.

Because your wife is the primary sponsor she needs to fill an I-134 and your cosponsor needs to fill one as well.

Yes, a copy of the W-2 and 1040 can be used instead of the tax transcripts.

- Is it strongly recommended to get past 3 years tax returns or the last years is enough?

Most will send the past 3 years just to be on the safe side. No need to give them a reason to deny you for something you can get pretty easily and for free.

OMB No. 1615-0014; Exp. 04-30-07 Has nothing to with expiration date of the form, it has to do with data collection by Office of Management and Budget. It is a date that other departments have to complete a usage survey mandated by the paperwork reduction act.

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134 signed and notarized.

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.
