Hi everyone, My 129f was approved recently, im waiting on news from NVC. In the meantime my fiance and I have been making plans for our wedding and honeymoon. We really wanted to travel after our wedding to PR as our honeymoon. We had doubts since Ive read on here that some ppl have difficulty returning when leaving to PR or VI. I called USCIS yesterday and today and recieved two different responses. My questions were:

first call on 12-26-07 to USCIS

1. Can we travel to PR on our honeymoon, him using his K1 visa?

she asked me to wait.. placed me on hold, then she responded " yes you can , its within US territory"

2. If we do travel to PR the day after our wedding, can he use his fiance visa as ID and to return to Texas?

She said, yes, but after you get married you have to file for 1131 and wait for a reciept number and then travel. he cannot travel out of the country. " I said, not out of the country but to PR. she responded, yes he can.

I asked her again, can he use his fiance visa as a travel document, or ID during our honeymoon, being that it will not be expired since we plan to marry at the beginning of the 3rd month? and eventhough we're married and its a FIANCE visa?

she said again "yes he can" but make sure you file for I131.

This confused me, and with her tone of voice she sounded doubtful and I just didnt trust her answers. so...

I called today :hehe:

i spoke to a very nice helpful lady. I asked her the same thing.

plus i told her i wanted to make sure since ive heard some ppl have problems when returning.

she said "there shouldn't be a problem since its within the US, but I cannot tell you for sure" she asked to give her time while she looked up the answer on her computer, she could not find an answer to either question, so ,,she gave me the number to call Washington D.C. customs, so i can ask them directly. it was a 202- something number, when i called there was an answering machine saying lines were busy, it wasnt an automated service saying ,,youve called such and such place. It was odd. I haven't tried again.

I appreciate any suggestions. Has this happened to anyone? :unsure:

11-15-05 He flew back to Buenos Aires.

03-19-06 Met his family in Buenos Aires. Stayed for a month.

01-13-07 Arrived in Argentina. Plan to stay 3 months.

03-12-07 Asked for an extension, will stay 3 more months.

07-07-07 Got engaged! Party!

07-13-07 Im back home in Texas.

07-17-07 Sent I129f application.

07-27-07 NOA 1 received.

10-02-07 2 year anniversary.

12-07-07 Application approved! NOA 2 via email.

12-17-07 NOA 2 Hard copy received.

01-04-08 Received letter from NVC! On its way to Embassy in Buenos Aires!

01-05-08 Shocker!! My fiance receives letter from Embassy with instructions Packet 3!

02-07-08 My fiance dropped off Packet 3 at embassy! waiting...

02-15-08 My fiance receives email -embassy asking if he had his medical exam done( he has) , they will notify him

of interview date later...waiting...

02-29-08 waiting,,,no news yet!! cant take this anymore!!!

03-14-08 After a few emails, received a response, Interview on april 15 at 1 pm.!!! :-)

5.12)...Is it okay for us to go to the US Virgin Islands or Puerto Rico on our honeymoon without Advance Parole?

A...Maybe not a wise thing to do. Even though these islands are US territories or possessions, you may have to deal with Immigration and Customs to get back to the United States. You might have trouble getting back home if you encounter an insane USCIS (INS) inspector, plus, there are too many opportunities to "technically" leave US jurisdiction (by visiting the adjacent islands, for example). Best to take the honeymoon somewhere in the 50 States, where there is plenty to see and do.

A..Let me make it as clear as it was explained to me and which the regulation bears out: So long as the K-1'er does not depart ("depart" is also defined in the reg.) the US after making a legal entry s/he can travel to any other location which includes the USVI, PR, Guam, Hawaii, and Alaska.

The inspector I spoke to gave clear examples. (My alien fiancée) can enter the US and we can fly directly from the mainland to the USVI. We can go wherever we want on the islands so long as we don't "touch" ground or water not under US jurisdiction. When we leave she shows her K-1 and I-94 to immigration (which shows she legally entered the US) and off we fly directly to the mainland. However, if while we are there (USVI) we decided to take a trip to the British islands then she would be denied re-entry. I know I used "directly" in this example but we could fly "outbound" mainland-PR-USVI and "inbound" USVI-PR-mainland without fear because in this case she never "departs" the US.

Inspectors (both mainland and USVI) told me that this is not an unusual occurrence. They see K-1'ers all the time.

I agree with YuandDan: even though PR is a US territory, it's just too tempting for a border guard to not let you back in. What about Hawaii?? Where else can you see a snow-covered mountain, huge telescopes, volcanoes, great scuba...and some of the best coffee in the world?

THIS Doesnt make sense...If they will give all of us a confusion ,why not TELL to the world or inform everyone that GUAM/PR/VI and other Places that is under US territories that its okay for us to travel and go back and forth fr mainland to those us territories.. IM SO CONFUSED TOO

HUBBY AMERICAN CITIZEN: travel in GUAM and tehy dont even ask ofr his PASSPORT

ME as CR1 visa holder and my GC willexpire next yr and need to remove the conditional next yr...IM so confuse coz i havent been there and plus IM PLANNING TO GET a US CITIZENSHIP on my 3rd yr here in US. NOT SURE if this will affect my STAY IN US> if i move in GUAM ..again WE are moving there next month sometime in JUNE im wondering DOES THIS MEAN tht AS US territory I CAN jsut change my ADDRESS in USCIS for them to send my new GC for 10 yrs and some docs.and not worrying of being in OUTSIDE THE US.since its US TERRITORy? GOSH wish they made this all clear to everyone... cna somebdy HELP ? me too?
