I came in US AS A TOURIST in 2004 and I will marry with a US citizen… how I adjust my legal status after marriage? Please help!

I live in US since June 2004 and I applied for I_589 procedure in 2006, like a political refugee, but my case is still in immigration court hearing.

8 month ago I met somebody and we love each other so we decide that pretty soon we want to marry. How can I adjust my legal status after marriage? What do I have to do? I try to figure out by myself which forms I should filing up reading USCIS site but…I didn’t found the answer…

I need desperate HELP and any advice will be appreciated.

I hope that the person you have met is US Citizen.

Is not clear on what stage you asylum case is. Have you been before the Immigration judge? If not

You have to ASAP

1.get married

2.file for AOS indicating your current status – pending asylum

You don’t need a lawyer for this.

Just an information for some of you who are reading this post

There are applications for asylum in USA from French, Spanish and German citizens.

To the OP: point is, if you are not in removal proceedings (since you weren't clear about that), you can apply through marriage. All this screaming and yelling about when Romania joined the EU is pointless and doesn't answer your question. Still, speak with a lawyer.

Are you sure the OP can file AOS through marriage, having a pending asylum petition? I believe the asylum has to be withdrawn first... and that's where the mess begins to make AOS problematic.

I think it does, or it can cause problems. Just wanted the OP to glean from this that he/she should be able to file based on marriage, but always always always speak to a lawyer first. The discussion had become a screaming match about whether Romanians can file for asylum, which is a moot point as it was done back in 2006. If the petition is withdrawn and one based on marriage is submitted, whether or not the asylum petition would be approved is a moot point - only reason I brought it back OT.

And yeah, it could make AOS problematic, but as it was a "can I...?" and not a "Will this be hard...?" I was just going for that.

03/26/2009 - received in VSC

07/20/2009 - card production ordered!
