I have received a W-8BEN from Bank of America. I opened a BofA account in 2004 when I was a student, so a social was not required as I was a non resident. I've made a few deposits here and there since then as I use it as my primary bank account. I received this form a few days ago, and it is saying if I am a non resident I need to state this and send the form back. However since my wife and I have been working we use this account jointly and make deposits without realizing this would come about.

In a nutshell, should I wait until I get my SSN - add it to the account and ignore the W-8 and pay taxes normally... or fill this out and send it back? I am afraid if I do this wrong it may impact me later. I also plan on waiting until after the interview, just in case.

Is your wife's name on the account too? You may try adding her name to it so that it is not closed. Other option is to go to your local branch and explain the particulars. You may have to close it and open in new one under your wife's name.
