Hi everybody,

My original plan was to mail my I-129F packet tomorrow, collect and notarize info for affidavit of support over the next month, and then go through with my longstanding travel plan to go to India to be with my fiancee from early Feb to mid Jun.

So I called USCIS earlier, and the person I spoke to said that my forms should be notarized and filled in only after I receive the NOA2. So then I thought, okay, I can have the NOA2 mailed to my address in the states while I'm in India, and then when I come back in June I can get things notarized and submit the affidavit. Looking at the timelines on here, I figured I could expect to receive the NOA2 in about April. So I called USCIS and asked what the grace period for submission of the I-134 is, and the person I spoke to said that there is no set amount of time, but that it is usually between 30 and 60 days. Which would be while I'm India, most likely, and then the case would be considered "abandoned" and be rejected.

What should I do? Is there a way around this? Should I cancel my travel plans and wait?

sorry the petitioner dont submit the i-134 to uscis ur fiancee only need that when he's going for his interview at the embassy

Right! We don't call it the misinformation line for nothing. Your fiance will hand over the I-134 to the Consular officer at interview. It is never "submitted" to USCIS. They get it in the sealed brown envelope your fiance will carry to the USCIS and hand over to CBP. CBP sends the package to USCIS.

No worries. Just don't return the Packet 3 until you know you'll have time to get home and get the I-134 notarized.

On another note, it seems the person you were talking to was thinking about an immigrant visa, where an I-864, (the other affidavit of support) would be submitted after NOA2 but not to USCIS. It is submitted to NVC.

If I were you, I'd stick with the plan you have and then prepare an updated I-134 as back-up, in case they don't like the older one.

It is best if the financial documents are dated as close to the interview as possible. Most people will have them dated a month or so before the interview.

Your fiance takes the I-134 to the interview but, if you are in India you can get it notarized at the US consulate there if you want.

Once you get the NOA2 the consulate your fiance will have the interview will be contacting them. No more communication from USCIS for you. As long as you have an address for you to get the NOA2, you should be fine. Is someone going to be chekcing your mail? You may want to have someone do that on the chance that you receive an RFE and need to respond to it because that information is not available via the USCIS case status website.

I'm not sure what the case being abandoned or rejected is about.

Thanks to everyone for replying. I really appreciate it, and I know everyone is busy due to the holidays.

So now, based on what you guys are saying, I guess this should be my plan. Please let me know what mistakes I'm making:

- Send I-129F now.

- My friend whose address I will use with USCIS will contact me in India when I've received the NOA2. I can let the NOA2 sit here untouched until I come back.

- My fiancee will receive notice from Mumbai interview requesting that she pick up forms and checklist.

- I come home, even a couple months after she receives word from the embassy, get the NOA2, get I-134 and everything filled out and notarized, and send this packet express to India.

- After receiving my mail, my fiancee notifies the Mumbai embassy that she's ready to schedule her interview

From what you guys said, it also seems like the one thing I should be worried about is if I get an RFE while I'm away. Is this correct?

You do not get anything notarized for the I-129F packet. After you receive NOA2, USCIS will mail your petition off to the NVC (National Visa Center in New Hampshire) and they will run a security check on your name there. It then gets forwarded to the consulate in India that you listed on your petition. After the consulate receives the petition, they will mail your fiance a packet with a list of things she needs to get together (police certificate, vaccination records, birth certificate), and that list will include your I-134. For the I-134, you must get a statement from your bank and place of employment, as well as Tax Transcripts or copies of your tax returns + W-2's for the last 3 years. You can get the I-134 notarized at the local US Consulate where your fiance lives. So, if you can gather everything else together for the I-134 (bank + employment + tax info+paystubs), then you should be fine staying there through the process.

As said earlier, you will want to be sure someone is checking your mail as you COULD get an RFE (request for evidence) where you would need to send more proof of your meeting in the last two years.

Looks like a good plan :thumbs:

Yes, the only thing I would worry about is the possibility of getting an RFE because the responses to that is time sensitive and you want to deal with that ASAP. Other than that, once you send the I-129F you should be good to go.

Your fiance may receive an interview date, ie, she may not need to actually schedule it (you may want to check and see what the procedure is in India). But in any case, you can send her all the other info when you get back to the States.

Posted previous post while you were writing yours, sorry ^_^

you can print the I-134 off online and have your friend mail you the NOA2 if you are interested in getting the process done as quickly as possible. That is, of course, if you can get all the other I-134 info while in India. Just FYI, it is a good idea to make a copy of everything in your I-129F packet for them to see at the interview, and in case there is an RFE for something that was already sent in.

You might wish to drop into the South Asia thread south asia where many other persons from India have gone trough what you are in process of doing.. .. come on in and say howdy... or simply read what others have gone tru
