my fiance came here illegally 6 years ago from Mexico. We started dating a year and a half ago and we are now getting married. We talked to one attorney and she said the best option is for us is to get married in Mexico and then apply for the K-3 visa and the I-130 visa. Does any of you think this is the best option? Also we have a a problem he uses a fake soc. security card and resident card. Can they find out?

This is complex.

He is not eligible to adjust his status to a permanent resident since he entered the US without inspection...

Your only option is for him to return back to Mexico, apply for the visa, get denied, and then apply for a waiver for his inadmissibility. The good news is that these waivers are usually approved at Cd. Juarez. This will definitely require the help of legal counsel.

What is the waiver for his inadmissibility?

its because of his previous illegal into the US. As a matter of law they will automatically deny him a visa based upon marriage to a US Citizen. But they will explain to him at the same time that there is a waiver available to him. This may take 6 months or more to be approved. In the meantime he would have to wait in Mexico until the waiver is processed.

They are attorneys out there that specialize in this process.

Also read the forum below regarding waivers, etc. Many people here are going thru the same thing.

This is probably a bad idea.. the whole point of the waiver is to make the case that living with your spouse in his home country would be a hardship to you.. if you're living with him while it is processing.. that would really poke some pretty large holes in your argument...

I have thought about that. We was going to get married in Mexico and I was going to stay there while he finished College and got the visa approved. Do you think if I left and went back to the US after the wedding, then waited until it was approved and then came back there? Do you think that would work? Sorry if I confused you.

9/9/05 I-130 APPROVED!!

2/13/06 CASE COMPLETE per NVC - got letter on 2/25/06

3/28/06 - INTERVIEW SCHEDULED FOR 5/2/06 @ 10:30 A.M.

Medical scheduled for 4/10/06 - everything went great!!

5/2/06 - INTERVIEW - APPROVED !!

5/20/06 - Crash came home to NY for good!!
