what's next after annulment?

can we file the petition as soon as i get the finality????..my fiance is planning to do so...correct me if i am wrong but i have heard that you can file the petition for k1 as soon as you get the finality and make sure i will have the annotated mc before the interview..thanks again...

We filed our petition once I got the decree. What we attached in our petition were photocopies of the decree and the decision. We did not include the finality and the annotated MC.

thanks raquel!!this has been confusing me..i hate to sound so paranoid but my question is..is the decree different from the finality???all i have right now is the decision and im waiting for the finality...which come first is it the decree or the finality??....

we really wanted to start the process right away..and i know having just the decision at hand wont be enough for the petition..god bless..happy new year

1 We got out decision...Now waiting for the finality...

2 After we get the finality we go to the ofice where we filed her annulment and have it documented...

3 Then she will have to travel to where she got married and have it documented there as well...

4 Then mail it to the NSO and get the copy there...

Is that the proper procedures... at what point will we have adiquiate documentiation to place with our k-1 packet so that we can submit it? 1-4? looking for a straight answer...

The answers to your questions are found in the responses to the thread above. If your fiancee is still stressed about it, the BEST thing to do is ask the court where the annulment has been filed. ..talk to the Clerk of Court and I am very sure she will be given the steps what to do next after she gets her certificate of finality to the registration of the same in the LCR and NSO. . the court is the best source if she is still isnt sure of what to do after reading the responses.

Once you have the decree. You can work out the NSO stuff afterwards. I am in Baguio right now having a vacation and can't go online that much. I'll be back on saturday afternoon. I need to correct you on the info that you are providing or you are going to confuse them more. The Decree of Nullity of Marriage will not come from NSO but from the court where they got the decision.

Same here, I've been there done that kind of thing myself. In fact my interview date is on February 7, 2008 and I passed my medical already. I think what you were referring to as the "decree" is the annotated marriage certificate. I have 3 copies of that myself.

I have even read in one of the topics here a year ago where a woman who is now with with her husband in Texas said that based on her experience during the interview was that Decree of Nullity of Marriage with a court seal is the most important document to prove that the previous marriage has been terminated. I don't think you will get a court seal from NSO if what you are saying is that the decree will come from that government office. The court seal is from the judge that issued your decision.

Alohaz, I just want to add that we didn't get any RFEs during the processing of our petitions at California Service Center. I hope that you will not get any RFEs too cause I saw in your timeline that you have only sent your petition last Dec. 14, 2007.

i pray hopefully not coz we pass all the evidence my fiance and i are almost 7yrs,we have 3yrs old son and since i give birth he always come here in the phils.
