Dear All

first, i would like to thank all of you for this huge website.

second i would to share my case with you , because i have little information about US law

here you are; by year 2000 i came to the US illegally without any visa on my passport, i worked hard till i got married to a US citizen , marriage lasts for two years with my USC wife, trying to legalize my situation in this country , but unfortunately my wife had left me , therefor all papers which i submitted to the USCIS denied immediately because of the divorce , then i came back to the illegal situation again, in year 2003 there was a new act telling all illegal people in the country to pay some fee ($1000) , and i paid that fee.

i worked with some establishment and i asked them ti file a petition for me and they did so, they sent a petition for the labour department and they approved it, in fact they sent me a notice telling me that the Permanent Employment Certificate has been approved by March 2006, then by June 2006 i filled the form I-140 and i sent both employment certificate and I-140 to USCIS and wait for the response from them, then by feb 2007 they sent to me a notice of action(form I-797c) telling me the following "I-140 has been approved, but you are not eligible for adjustment of status at this time", but i dont know why and from time to time i used to ask the attorney but unfortunately he know nothing just like me.

and i used to check in USCIS website , using my reciept number for any further information but unfortunately nothing come out except a small sentence telling me that they sent to me a notice of action by feb 2007 , now i dont know what to do and i don't know any one to ask about this issue except the attorney and that guy is not helping me at all .

so plz guys is there any suggestions you have for me , is there any one having a case like me and wanna tell me what to do and how.

I know hardly anything about employment based petitions, but I think you need an immigrant visa number before you can AOS. when you get the immigrant number will be based on your priority date.

hopefully someone who knows about AOS from employment based petitions will be able to answer your quesions and correct me if I've given any misinformation.

I'm not sure where you could ask this, but VJ isn't going to be of very much help - pretty much 100% family based petitions, not employment based.

How did you get into the US without any visa from Jordan? I mean you have to fly from there here, meaning your POE would be an airport and I cant see them allowing entry without anything in your passport.

Regarding your current situation, were you sponsored by an employer?

Also, I believe you should get the advice of a different attorney if you know yours doesnt know what he/she is doing. Checking the status on USCIS site is pointless if you dont know what the next step is or should be.

What you are is an illegal..just like the other 12 million of so. You cannot adjust status unless you took advantage of the LIFE Act back in 2000. Evidently, that did not work out.

Have a nice flight home.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

I thought the OP is saying that he paid the necessary fee to make himself legal - did I misunderstand?

In 2003 - AFAIK, there was no "fee" back in 2003 you could pay and make you legal.

thanks you all for the responses, in fact I'm so sorry i made a mistake , the fee which i paid was in 2001 not 2003

and you are right that fee was to make myself legal in the country.

now the question is ; is it right that the NVC has to send to me a notice telling me that they received the case from USCIS, because till now they have not sent to me any thing, in other words; when the I-140 has been approved, is the next step to send the case to NVC and the NVC by then has to send to me a notice that they received the case and they are working on it?
