I have met, and married, someone who legally entered the US on a J1 visa.

The visa expired 4 months ago.

We would like to adjust status, apply for a SS card, work permit and travel permit.

Can someone please advise us as to the proceedures and likelyhood of success.

When i entered on J-1 I applyed for my ss card right the way a nd had it within 2 weeks but your case might be different You should go through I-130 process i don't think it will be any problem as far as I know a lot of people get married after their visa was expired

so good luck with your process

Service Center : Vermont Service Center

Consulate : Ukraine

Marriage : 2006-11-02

I-130 Sent : 2006-12-11

2008-05-16 CR-1 visa issued

2008-05-20 recieved visa

2008-05-31 I arrived at JFK (took me 1hour and a half to be out of the airport with a stamp in my passport)

10 year GC

2010-03-06 I-751 sent

2010-03-09 NOA-1

2010-03-10 check cashed

2010-4-12 Bio (done early 3-29)

2010-6-3 card production ordered

2010-6-19 10 year GC recieved

N-400

2011-3-28 application sent via express mail to LEWISVILLE TX SC

2011-3-29 application recieved

2011-4-20 early BIO

2011-6-16 interview

2011-7-29 Oath

Apply for EAD at same time and include it in the same envelope, use code (c )(9 ) I-485 pending.

You pay fees for the I-130, and I-485.

File everything to the Chicago address for I-485.

Can only apply for SSA after receiving the EAD or green-card.

Is it really true that you need a green card "before" you can apply for a SS card?

SSA will only issue a SSN to a person who is authorized to work in the USA.

Evidence of work authorization are:

  • US Citizen's birth Cert.
  • Certificate of naturalization.
  • Work authorized NON-Immigrant visa like K-1, H-1B, H-1C, H-2A, H-2B, H-3, L-1, O-1, O-2, P-1, P-1S, P-2, P-2S, P-3, P-3S, Q-1, E-1, E-2, R-1 or TN with valid I-94 card.
  • EAD card
  • Green-Card
  • Foreign passport with I-551 stamp.

You will mail everything (I-485, I-130, I-864, I-765, and perhaps I-131) to the Chicago PO box listed in the I-485 directions.

Although I searched, I can not find the address where I need to send these forms for AOS
You will mail everything (I-485, I-130, I-864, I-765, and perhaps I-131) to the Chicago PO box listed in the I-485 directions.

It is imperative that you read the instructions carefully for all the forms. What Dan is short-cutting for you is to tell you all the forms go together to the address in the I-485 instructions. When the forms are filed separately, they may go to different addresses. Yours need to go together.

Facts are cheap...knowing how to use them is precious...
