Hi...

Since I want to travel next year to my home country, I applied for and received my AP . We still havent received the green card after almost 2 1/2 years due to pending namecheck...

We received the AP documents (both) and is that It????

No instructions to do anything else. I thought we would have to go for fingerprints again but it doest say anything..

Please let us know and Merry Christmas to All!!!!!!!!!!!!!!

We are worried because we havent had biometrics since June 2005 so they are definitely expired now. We wont be traveling til this June, 2008, and we still are "pending FBI namecheck" all this time.But we do have both AP documents in hand and want to make travel plans. I'll be stressed til we reenter the US after our trip abroad I guess.

Still hoping for a miracle "green card" before of course but I feel like we will be in the famous black hole for years! We will be celebrating our 3 year anniversary soon! We will be applying for another EAD at the end of next month...Just more and more money!!

I just hope that with expired biometrics there will be no hassle.

My husband has been stuck in name check for a while too (not as long as you--we applied two years ago and just had our second anniversary), and he has traveled on a renewed AP with no problem. As Donna said, a separate biometrics appointment is not required for AP--although it is for EAD, as I'm sure you know! Your biometrics are probably current if you have a valid EAD; it's your fingerprints that have expired. It's the responsibility of USCIS to inform you that you have to have them retaken. My husband's fingerprints were last taken in February 2006, and he traveled abroad this past summer, after they would have expired. I don't think the port of entry officers care about that as long as you have a valid AP.

When you travel, make sure you take both copies of the document with you. When you re-enter, you'll likely be taken to "secondary" (sounds scary but isn't), which at most airports is an area adjacent to the immigration desks. A different officer there will process it. This can take a little while depending on how many people are also waiting. We've never had to wait longer than about 20 minutes for this, but keep this in mind when booking your travel--you don't want to miss a connection. The officer will keep one of the copies and stamp the other and return it to you for future travel.

September 20, 2005: K-1 Interview in London. Visa received shortly thereafter.

AOS

December 30, 2005: I-485 received by USCIS

May 5, 2006: Interview at Phoenix district office. Approval pending FBI background check clearance. AOS finally approved almost two years later: February 14, 2008.

Received 10-year green card February 28, 2008

my husband had traveled twice on his. so far so good. the second time he came back they gave him more of a hassle (if thats what u want to call it). they just asked alot of questions like, how long were u gone, where did u travel, why? to him that is a hassle and stupid but thats the rules.

hopefully one of these days we will all be past this AP ####### and proud owners of a green card. being stuck sure sucks. weve been stuck 3 years and its not a pretty picture as u already know.
