Would I need a sponsor?

Timeline

I(petitioner) have lived abroad for four years and just returned to the states Jan of this year. I have duel citizenship and was working abroad as a local citizen and never filed tax return in the states in the years I lived there.

I am self employed in the state now and didn't work for many months this year and the total income for the year is about $25,000. I live in New York city and there is no way anyone can survive with $25,000 income. I will definitely make more than that next year as I will get more cases. Would they ask me to get a sponsor?

Also, does the petitioner need to get police certificate? I have no criminal history. If so how long does it usually take?

Well, you do meet the income requirements, even though in most cities, the poverty requirements are way below any decent means of living.

The petitioner does not need a police certificate.

All they care about is you make over the 125% threshold. They don't care if you live in NYC or Hole-in-Wall, Montana.

February 12------VISA in hand

February 22------IN the USA

March 1-----------Wedding

March 15----------Sent AOS

July 7 -------------Finger Print

January 27, 2009--Green card approved without interview. It took almost one year though.

Feb 2 -------------Got the green card in the mail

Next: playing the waiting game for the 2 years holding removal

Timeline

Bring it to the Embassy or consulate at the interview. Since they are good for a year, some people like to get them after the'yve received their 2nd NOA. One less document to worry about.

When does the beneficiary need to provide police certificate? When submit initial document stage or during interview?

Yes, the FBI does anycriminal record check for the petitioner and 125% is the stated minimum requirement. However, nobody can assure you that 125% will be enough to get the visa. We've seen requests for sponsors even from people making over the minimum. Consular officers are tasked with determining that the immigrant is unlikely to become a public charge. They can use whatever criteria they deem appropriate for doing so.

The OP would be wise to fully document their expected income for next year but it sounds like it is not a firm salary, just an expectation of a higher volume of work. An additional sponsor may well be a good idea.

Ultimately, this is true. One could make 500% of the poverty threshold, but if the C/O has a bug up his butt, he can still deny you, if he feels the beneficiary could become a public charge. The 125% is a basic guideline but covers all 48 contingence States with the 125% being a tad higher in Alaska and Hawaii. They do not, however, make any separate guideline for specific Metro areas, e.g. NYC or LA. Most people will not have a problem if they make the 125% and can satisfactorily document it.

Since the poverty level calculation is so out of date, it doesn't matter. A true poverty level calculation would be city-specific, but since the US government doesn't do this, they don't care.
