Predicament! HELP!

Hi,

Quite an interesting predicament we are in here.

My wife is the USC, and she makes well over the poverty line, so there arn't any joint sponsors. USCIS and NVC are both complete, and our file is in London.

She was at school full time until mid 2006, which is when she came over to the UK and we got married. She had a job at her University in California, but wasn't required to file any taxes, but she doesnt have the proof of that. Also, she was here in the UK from mid-2006 until mid 2007, and therefore hasn't filed any US taxes for that year and doesnt have any Tax Returns or proof or anything that might show why she hasn't filed taxes. (cos she was a student, and she was here in the UK - obviously she cant file taxes in the US if she is here in the UK).

She has since gone back, and has a very good job in LA, but only started that July '07. (but making well above the poverty line)

I have my interview in mid Jan, and don't want to be given a 221 (g) form from the Consular Officer just because i didnt have the correct docs to show him/her that she didn't/wasnt able to file taxes for those last couple of years? WHAT DO I DO? Is it even going to be a problem?

I know what i wrote might seem confusing and i repeated myself a bit. This is the main thing that is making me nervous about the interview.

Anyone with any insights into what could/will happen because of our situation, PLEASE TELL US!

Well, first of all, your wife can write a letter explaining the circumstances for not filing.

I filed an Affidavit of Support under similiar circumstances. Currently working in year 2007, but unemployed in 2006 because I was living overseas.

My Affidavit of Support was not disqualified by the NVC. However, at the Consular level, my husband was issued a 221(g) requesting we provide a joint sponsor.

Yeah, sounds like i need to add a joint sponsor. I guess i'll get started with that now, so when im at the interview and receive (which i most likely will) the 221(g), i'll be ready to just give them the joint sponsor info.

I hope all this doesn't lead to trouble with the IRS, but citizens of the U.S. are required to submit completed tax forms if above a certain income level even if they owe no taxes and the income was earned in another country. Also if she was working in the UK, there should be income reported and taxes paid there that you could use. Other than sending the '07 return if it's done, she can submit pay stubs and a letter from her employer, but they will probably want a co-sponsor.

While she was in the UK she was required to file a US tax return, my wife lived in the UK for 10 years and filed a US return every year. Never had to pay US taxes but was legally required to file the return.

If your wife had been living in the US and exempt from filing a return then she would have been exempt under the same circumstances while living in the UK. But unless that was so you will need a copy of her tax return for 2006.

You will need a co-sponser.

But you also can't just say she wasn't required to file without proving that.

1st: She needs to get a hold of IRS by phone right away and ask for all the transcripts they have on her for the last 3 years.

2nd: If they show any income what-so-ever, File a late return right away. To delay would be to have it come in @ the heart of tax season.

3rd: Get transscripts from the uk side stating her income and have her file on that 2.

You guys sit on this way to long and have boxed yourselfs into a time corner.

December 12 2006 Filed I130

Jan 10 2007 got receipt and case number!

Jan 12 2007 sent 129F

Feb 6 notice they were moving the file to a faster service center.

Feb 26 Notice of I130 approval

Feb 28 2007 notice they were sending 129F to USCIS for further investigation (err #######?)

May 15 2007 notice of approval of 129F with processing dates of 05/15/2007 thru 09/14/2007

May 28 2007 Notice from attorney that NVC needed processed and money orders were needed.

June 4 2007 Traveled to Manila to spend 2 weeks with my wife!! (YeHaaaa!!)

Fed-xed her signed papers (For NVC) from Manila to attorney from Manila while on vacation

June 18 2007 Nvc approved support.

June 29 2007 packet arrived @ my home informing of interveiw for I130 on Aug 27 2007 and explaining Medical interveiw.

(Note wife never received packet for I130 in Philippines I fed-ex'ed mine to her for medical interveiw)

July 17 2007 packet arrived for 129F setting interveiw for Sept 5 2007

August 5 2007 Wife flew to Manila for medical interveiw on August 6.

August 26 wife flew to Manila for I130 interveiw on August 27 2007.

August 27 2007 12:31 pm I130 Approved

wife arriving Nov 18th

WIFE ARRIVED Nov 18th!!!!

Thanks for your advice, looks like i got some work to do. I'm getting a co-sponsor as i write this... obviously it's too late to send it to the NVC, do you think that it might be accepted at the interview, or will i need to mail the sponsors affidavit to the London Embassy ASAP!??? or am i gonna have to wait until i have had my interview and they give me a 221(g) form for lack of evidence.???
