Originals/Photocopies/Notorized copys for I-864 income/assets

Trying to pull together documentation for I-864, I'm self-employed with complicated income so I can on explaining that but also submitting evidence of assets to back it up. My question is exactly what are they looking for? I don't want to send originals, I also don't particularly want to shell out $200 to get 20 pieces of paper notorized. Can I certify & sign that copies are real and originals will be made available at interview?

Instructions are clear relating to tax documents, not so clear on other documents, they just say "proof", they don't say what "proof" is ...

My documents:

- bank statements

- stock certificates

- investment fund statements

You don't need to send originals or notarized copies. A plain photocopy of the documents should be good enough, at least that's what I did with ours.

Timeline

An easy way to deal with complex financial evidence, is to order simple IRS return transcripts.

Keep this simple, if income exceeds 125% poverty line, then include only income data no assets needed.

Also nothing needs to be notarized for I-864.

Are the Affidavit of Support forms required to be notarized?

No. The sponsor just has to sign the form. You should know however, when the sponsor signs an Affidavit of Support form, he/she certifies that the information provided, transcript and/or photocopy of tax documentation is true and correct, under penalty of perjury.

Received Green Card: 05/12/2008

Feb 4,2007 - I-130 accepted > Get USCIS case Number NOA1.

May 8 ,2007- GET NVC Case Number > NOA2.

June 16 ,2007- Get Order from NVC to pay 70$.

July 2 ,2007- Get DS-3032 in India.

July 7,2007 - DS-3032 choice of address agent entered in NVC.

July 14 ,2007- Get I-864.

July 18 ,2007- I-864 Enters NVC.

July 29 ,2007- Get Order to Pay 380$ fee.

Aug 3 ,2007- 380$ Fee Reached St Louis.

Aug 25,2007 - NVC & St Louis People receive photocopy of my payment with USPS receipt.

November 20, 2009 - Arrested on Domestic Battery(Had argument with wife)

December 18, 2009 - Biometrics Completed at 9 am.

January 13, 2010 - Receive I-797E Notice for more evidence

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1

Photocopies will be fine, just save the originals for the interview in case they ask for them. You can get a transcript from the IRS for up to last 3 tax years, but it takes a while to arrive, in case you want to order that to have at the interview. www.irs.gov.

Also to save time down the road, you can have your spouse download the DS-230 and get that info together and filled out and any NSO birth, marriage and FBI certifates if you don't have them with you, also a photocopy of passport, and sign part 1, but not part 2, then send it all to you so you can have it ready to go as soon as they send you Packet 3 requesting the form and supporting evidennce.

Adding my own final update.

This is definitely an important point and the I-864 documents are reviewed and accepted/declined by the consular station (at least in my case) in addition to NVC checking. They can be quite pedantic. The biggest point that surprised me is that tax return transcripts are expected for the previous year, even though in the early part of the year tax returns would usually not be filed by most people (think 4/15).

So if you think the interview might be happening in March/April/May you should be researching filing your tax return in January or February (even if you have to file a 1040X later to amend).

Oh, and here is the fastest possible way to get your tax transcripts. (1) the irs has to have processed the tax return, you can check this by going thru the automated 1800xxx1040 number and requesting them to be mailed - if the system accepts the request then they are in the computer (2) if you can't wait to receive the transcript by mail at that point (like in my case 9 hours before the interview), setting an account on efax.com, get through to an irs agent by phone (7am - late, in all continental US timezones, there is really only 4 hours weekend and weekend they are not available) - and ask to have the return faxed to you. Then print it out.
