Hi to all VJ Members,

I need your help guys!

I have been approved for my husband petition I-130 (receive NOA2 after 5 full moths, finally), my consern is AOS. For 2006 I am meeting the requirements for it, but since I was gone for a while from US I am not sure will I be able to meet for this year(2007), I am just little bit below and its gonna be very, very hard for me to find a co-sponsor and I really dont know what to do. Do I have to make "most recent" taxes (2007) when I`ll send the documents or I can go with 2006? Please help, any advice will be appreciate, I am really confused and need your HELP!!! :help:

Hi Dana,

If it is after April when you send in your I-864 they will be expecting your 2007 tax return figures/transcript.

Depends when you actually get to send it in. As for the statement on your I-864 about your annual earnings, you would state what you would normally make in a calendar year, not what you made this year. I assume in a 'normal' year where you are working all 12 months you will be over the poverty line at 125% ?

Plus, even if you squeak in and don't have to send in the 2007 transcript with your AOS, they might want to see it at the interview. It might not be a problem though if your 'current salary' is sufficient - do you have any assets you could use to top up the figures?

NVC wont ask for 2007 data until after tax filing deadline in April, if interview happens in April, the consular officer could ask for more up to date financial info such as copy of 2007 return.

Attach recent pay stubs and employer letter to the I-864, also you can use assets to make up the short fall, assets = 1/3 income.

We applied for my wife's AOS in July 2007, and I clearly stated that I had filed for extension for 2006 and therefore had not included the return. But, the USCIS wanted to see 2006 anyway. Luckily I was about to file when I got the RFE in August, so I was able to turn it around quickly. Like YuandDan said, try to get this done before April 15th if you don't want 2007 returns to count toward income.

11/13/2006 Received NOA1 - (Late due to my changing residences on 11/1. FYI, move before you file!)

12/02/2006 Received verification of Change of Address - snail mail

01/10/2007 Bought ticket to visit Pu on Valentines Day!

01/17/2007 NOA2!! via email

01/29/2007 NVC Left - Headed for Bangkok!

02/07/2007 Packet 3 mailed from US Embassy!

02/10/2007 Packet 3 received

02/20/2007 Packet 3 mailed (EMS Next Day)

02/21/2007 Packet 3 Received at Embassy (no signature)

03/06/2007 Received response from Embassy - Packet 4 mailed 02/28/07. Interview scheduled 5/16/2007!

05/16/2007 Interview. Embassy requests passport amended. Luckily the turnaround time is two days in Bangkok.

05/21/2007 Pu returns to Embassy with new passport, visa granted. Visa issued the following day.

05/26/2007 Pu arrives in USA!

05/30/2007 Married!

06/26/2007 Overnighted AOS petition to Chicago Lockbox

06/27/2007 AOS petition delivered to Chicago lockbox, signed for by V Bustamante

No, I dont have any assets that I can use, but if I go with my "normal" year income I will be ok, and as I understand I have to put that information in I-864 form as a curent "income", right? And, what about bank statement, am I gonna need to present or just if I "have" to,just to cover my recent income?

Bank statements are not requirements of the I-864 unless you are using the content of a savings account as an Asset.

Only thing required by form I-864 is past year's tax return or tax transcript, employer letter and pay stubs are optional.
