So some of you know that Tuyen and I failed to satisfy to the CO in HCM. Our case finally made it back to the USCIS in CA. The wait time on a decision could be 1 month al the way up to a year. If they decide that I did satasfy requirement, it could be another 3-9 months from the time it leaves the USCIS to another interview.

My attorney says that I can file a new petition and go with with a K-3. Then once the original case is processed respond to the Intent to Deny.

I am going through the same process and finally today I got notice through email. I had to go the I130 CR-1 route. It's been over 6 months and I'm still waiting for the denial of my K-1.

"On December 20, 2007, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service."

I hope this goes more smoothly than my first time around.

Hey Kevin,

As you know I had to file a new petition. I went with the K1 visa again since we are not married. Our new case has made it to the consulate and is now waiting for the Chief Immigration Officer to review it. They say this is the normal process for reaffirmed cases and people that filed a new petition after the first one was denied. He must decide if he will allow our petition to continue or if it should be sent back to USCIS. I included in our new petition an email from CSC saying our case was expired and I may file a new one. It may be a sticking point for people who refile without some sort of conclusion with the first petition. I will keep you posted on our progress.
