I understand that you need to have the most recent three years tax returns done when you are doing the I-864. I am thinking of filing for the adjustment of status in March 2008 and I am wondering if I would need to have 2007's return (not due to the IRS until April) or if I am ok with having the 2004,2005,2006 done. As the interview will more than likely be AFTER the tax deadline, if I am not required to have it when I file (due to filing in March), will they require it at the interview?

Please help.

Since you are filing before April 15, 2008 you may use 2004, 2005 and 2006. Also I would suggest you call IRS and get official IRS tax transcripts to submit also with your application, USCIS seems to like or prefer those.

Technically only the most recent tax year is suggested - the wording used is "You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years."

To your question - although since tax returns are not late until April 16 (or whatever date it is this coming year) - 2007 will (whether you've filed or not) be your most recent tax year. No real advice except if you are waiting to file your taxes until after you file for AOS (etc.) then I would certainly include any other (most recent) methods of proving income (as suggested on the forms). And yes, they may ask for it at the interview (should you have one). :thumbs:
