Well we have our wedding date set for February 14th, 2007, Valentines Day! We are planning on having a civil ceremony downtown on that day and then a samll party at our home for family and friends on the following Saturday. After the holidays we were going to get social security numbers for Isa and Isabella and then start the process of opening checking/savings accounts, getting her a credit card, etc.. How long after we get married do we have to file the AOS? What will we need to prove at that time, just that we are married? Any advice/specifics is greatly appreciated. I can not begin to thank everyone and this website for the wealth of information we have received. Thanks Again!

There is really no deadline to file AOS but you want to do it ASAP so that your wife can travel, work, get a DL etc.

I believe for AOS you need to submit your marriage certificate and maybe any other documents to prove you are married but I am not sure if that is necessary (someone else can give more insight).

Brian and Isa,

February 14th... Oww.. (L)

Keep in mind - the K1 is a fiancé visa - meaning it's valid for entry to the US (for purposes of marriage) - upon entry, essentially the K1 is invalidated (used) and the I-94 becomes the piece of paper that says you can stay (for 90 days) - again, so you can get married.

Once married (and the I-94 expires) technically you/she/he is out of status. To get from Out-Of-Status-Land and into Pending-ville (where many friendly people live), you must file AOS. How long you wait to do that is kind of up to you (since there's no one forcing you to do so). If you check the guides (and take a look at the required forms) you'll see what is required - basically you'll need to (yes) prove you're married, show proof of income (again, but this time on a different form) and pay the required fees.

Thanks everyone for the information. We just went yesterday to get Isa her Social Security Number and I must say having dealt with the red tape here in the U.S., that process was really easy, we were in and out within 15 minutes. After we get the soc. sec. card we will head downtown for the lmarraige license. Thanks again for the info., that puts my mind at ease with the AOS.
