My husband filled out and mailed AR-11 about 2 months ago. I called USCIS 2 weeks ago to verify that they had received it and they told me that they have no way to check on that. She just told me that we should receive a written notice in about 45 days and that if we do not receive it soon we could either go online and change it or mail them another form. We just went on the USCIS website to do that but it says that if you change your address online then you should not mail them the AR-11. So my question is do I change it online or keep waiting for the written notice?? I just don't want us to get screwed cuz they don't know what they're doing.

What I heard here when I sent my own AR-11:

1. Your hubby/wife HAS TO send an I-865.

2. He/she does hear back from USCIS; the immigrant does not.

Correct US Citizen sponsor must also file I-865 reporting immigrant sponsor's moving.

Just making sure I understand this. I haven't done my I864 yet, so do i still need to fill out the I865?? I mean I was the sponser for his I134 though. Anyone know??

Not sure about that part.... but pretty sure about the AR11 and I865... unless someone corrects me, which is totally cool

Yes, you still have to do the I-865 even if you have not done an I-864. The wording on the insructions is wonky (they are on every form!), but the I-865 is for ANY US citizen sponsor of ANY immigrant. If you move, you are supposed to notify the USCIS within 30 days. Even if you're late, you really should get it done.

The mods really should sticky this information somewhere, it gets asked so often.

Hmmm. We filed online to change my husband's address and we did not receive anything to indicate that the change had been made. This was before we filed for AOS, but we received the NOAs with no problem. Of course, we used the new address on the forms. But since I had not yet filed the 864, I interpreted the info to mean that I did not have to file a change of address with USCIS.

Is there a way for the USC to change address online or do we have to mail in a form?

Just starting the journey, haven't yet filed... Until today(2/12/07)!

1/8/08 - I-485 Receipt # shows up in case status

1/15/08 - Case transferred to CSC

1/30/08 - Email: EAD Card production ordered

2/1/08 - Email: AP approval

2/8/08 - EAD card received

4/4/08 - RFE for full medical

6/9/08 - RFE received at CSC (according to USPS)

6/16/08 - RFE received at CSC (according to USCIS)

6/19/08 - Card production ordered

6/24/08 - Approval email & Welcome letter in mail

6/26/08 - Card arrives in the mail

This is what it says on the USCIS website:

U.S. Citizens who do not have an application or petition pending with USCIS are only legally required to notify USCIS of a change of address if they have previously submitted a Form I-864 on behalf of someone who has become a permanent resident. If you have previously submitted a Form I-864 for someone who immigrated to the U.S., you must complete a Form I-865 within ten days of the completion of your move.

I know they do word things really weird but the only way I can interpret this is that I do not have to fill it out since we have not sent them the I-864 yet. I guess I will just try calling them today, not that I expect any kind of answer. And then I'll just send them the I-865 anyway.

I don't know the answers to all your questions but if you change your address online then you do not need to mail them the AR-11 too. I wouldn't bother calling them to make sure they changed it because when I did they said they had no way to check that.

If you move from one district to another, then they will transfer your file (or, they're supposed to). If you move from one district to another, then you MUST follow up with them, because if they don't forward your file, then your AOS will be set up at your OLD district office, and you may not get the appointment letter, then you'll be under deportation notice.

The I-865 also goes with the I-134 affidavit of support, so if you've filled out one of those, then you need to notify USCIS that the sponsor/spouse has moved.

Honestly, when possible consequences are a monetary fine, jail time, and deportation, why not just do it? Its just a piece of paper. There've been enough couples through here over the years who've been told by USCIS that they need to do it, even if they've not yet done an I-864. Better safe than sorry IMO.
