Every time my husband has an interview somewhere they ask him to explain the visa he's here on since no one has ever heard of it (K1--and the I-94 won't expire till Feb.) And no matter what he says, they still don't understand it and tell him to come back when he has a green card! :ranting: :ranting: :ranting:

What are we doing wrong? He is currently working weekends under the table but he's still feels like he's doing nothing. I think everyone who lives around here is racist :angry:

Sorry to hear this. I'd like to think it's due to misunderstanding of the laws rather than racism.

Here is the new I-9 and rules. Number 5 from list A says that they will accept an I-94 in a foreign passport as long as the visa class has employment authorization: http://a257.g.akamaitech.net/7/257/2422/01...pdf/07-5790.pdf

You'll see K1 is listed.

He should take these documents with the relevant sections highlighted so they can see for themselves.

What exactly is giving them heartburn? If you have the authorization stamp on the I-94, I would not confuse them about the K-1 as it is not so important a fact.

If he doesn't have one though, I thought that K1's were now permitted to work without the EAD stamp. I suppose that point is still up for debate?

There could be many reasons, the obious one is that they do not want to go through the hassle of employing someone who only is work authorised for less than 2 months.

I do not undestand the working under the table, I presume he has the temp EAD

That would be my guess, rather than misunderstanding. WHo wants to hire and train an employee who may have to be on leave as of February until the green card comes in?

As long as he decalres it on his tax return, not a good way to start your US journey commiting tax fraud.

And even less cleaver posting it on an open web site.

I don't think so. The language on the I9 says a visa authorized to work for an employer. Not a visa to come over and get married.

I don't think so. The language on the I9 says a visa authorized to work for an employer. Not a visa to come over and get married.

Then I agree with the others. I remember that my husband had a difficult time finding someone to hire him with just the EAD stamp as well.

To the OP:

I wouldn't give them the chance to wonder what visa he is here on.

My husband's resume' had the following statement on the bottom of it:

"I hold a valid Department Of State Employment Authorization Document and do not require any sponsorship to legally work in the United States."

Credit for that language goes to the member luv2teach.

He has the temp ead, so the working under the table thing is not an issue. Especially since he's barely making any money.

You haven't found a decent employer yet. If a company is worth their salt, they will understand if he can or can not work. Most applications have a question: "Are you authorized to work in the U.S.?" If you say, "Yes", you show them a copy of your work authorization as proof. It should be straight forward to a competent HR person. :thumbs:
