wait time until employment for k-1

Hey everyone,

quick question for those people on the forums who have already been through the k-1 process and now live in the USA. I was wondering (on average) how long did you guys have to wait before you could apply for ANY time of employment (fast food, janitor, etc)

The reason why im asking this is because i wont have much money when i move down (around 6-7k) but our plan is to rent a house(apparently its like 350 a month for rent lol) and live in my fiance's small town for a while.. so everything is cheap there.. Im concerned that the money will run dry pretty quickly. That being said, my fiance will be juggling working and going to school so its not like we'll have no income, i just want to give my share

If you go through JFK or some land border crossings, immediately for 90 days. If not, or after that expires, you'll be able to work approx. 90 days after the AOS package is filed with I-765.

Right... Several people seem uncomfortable working with a temporary EAD stamp that will expire in 90 days, and wait until the EAD they filed for with AoS goes through, which is 90 days from when you file. You generally want to file for AoS as soon as you can after marriage.

A good reason to consider an IMMIGRANT visa like CR-1, it results in a green-card upon entry allowing immediate work.

When deciding on a visa, determine your priorities, Immigrants can work, NON-Immigrants typicaly cannot work, a K-visa is NON-immigrant, K-1 is "work authorized" primarily to allow the fiancee to be able to get a SSN, some states interpret a federal law for licenses requiring both persons to have SSN before issuing a marriage license. K-1 is not a work visa it is a fiancee visa for foreign citizen to enter the USA to marry, K-1 is "work auth" to allow SSA to issue SSN.

From what I understand, yes. It expires when the K1 expires (90 days), at which point you can no longer legally work. Might as well just wait until the EAD goes through with AoS.

Technically the K-1 is VOIDED upon entry to the USA, it's clock stops then, and the I-94 clock starts. It is the I-94 that expires 90 days after entry. The "Temp EAD" is based on the I-94 expiration.

If you're working in Canada, you're probably eligible for EI benefits. Looked at the pinned thread at the top of the Canada Forum. Several of us are receiving benefits, and there is specific information you really have to pay attention to, to get your money quickly, so please do read the thread, and ask questions about EI in the Canada Forum.

Form I-765, but it should be filed with I-485 when adjusting status after marriage.

EAD can take up to 90 days to be approved, so if you attempt to file one based on K-1 I-94 card (a )(9 ) this EAD expires same time as I-94 card so is a waste of $340 because in most cases USCIS approves the "Temp 90 day EAD" after the I-94 expires resulting in an invalid EAD card.

K-1 need to file for EAD with or after filing the I-485, using code (c )(6 ) Based on pending I-485.

Many of the land boarder crossings between USA and Canada do the EAD stamp.

Just a clarification: most of the land crossings from Canada *don't* give out the stamp. Detroit and Peace Bridge both told us they could, but when we crossed at Peace Bridge they told us they'd never heard of such a thing and we could file for a I-765. (I pointed out this would mean it expired with the I-94 and the guy shrugged in sympathy.) Everywhere else I called along the border said they couldn't do it.

We got a stamp at Boston's Logan Airport on the recommendation of the Hartford USCIS office. I think we're the only ones that have (I'm not sure most of VJ believes me that this was possible!) recently. C. drove from New Haven to Boston and back for the stamp, about two weeks after we entered.

Honestly, it's such a dice roll that you're probably better off assuming that the stamp doesn't exist and budgeting from there. Even if you get it, there's still settling in and convincing someone to hire you on an essentially 90-day clock. File as soon as you can after marriage, and figure on about three months from filing to the EAD, and some time after that to land a job. Most people here seem to plan on four-six months unemployment.

We didn't look into it, but I think that the fact that the K-1 is work authorized suffices for EI.
