Hello everyone. I have a couple of questions and maybe somebody can help me. My wife & child came in to the USA with a K-3/K-4 visa respectively. Now we are filing for AOS and EAD but are still waiting for those documents. What we would like to know is this:

1. Can I get health insurance for my wife & child eventhough they dont have medical history in the US and dont have a SSN ?

2. Can my wife get a Drivers License whitout a SSN? If so how?

We live in Houtson, Texas and any help on this matter would be greatly appreciate it.

Thanks and god bless.

Happy Holidays!!!

1, YES, SSN is not a requirement for adding a person to a medical policy, I added my wife without a problem before getting SSN

2, NO  virtually all states require SSN to apply for a driver's license, there is a federal law on the books having to do with child support requiring SSN from persons applying for a license.

4) Social Security card or other acceptable proof of Social Security

Greetings!

The health insurance questions likely depends on the provider/employer, so double check with them, but I HIGHLY doubt there will be a problem. We haven't gotten to that point yet, but I've checked with my provider and there's no problem at all. In my case, they don't even need any additional forms or paperwork, just proof of marriage.

As for the driver's license, I'm sure that varies by state. I'd suggest a quick phone call to the local DMV. Unless it's urgent, though, you might as well wait until she has an SSN. She WILL need one eventually, and it usually doesn't take long to get. She should be eligible for a SSN before the AOS/EAD goes through (can someone verify this?).

Good luck, and congratulations!

Medical insurance providers may require an EAD or Green Card before you can add your spouse to your insurance. You will have to ask them about what they require.

This is not correct for Texas and many other states.

http://www.txdps.state.tx.us/administratio...uritynumber.htm

Individuals who have applied for and been denied the issuance of a Social Security number due to ineligibility or that have never applied for, been issued or assigned a SSN by the Social Security Administration may complete a Social Security Affidavit (DL-13). The affidavit will be available at the driver license office and must be sworn to before an authorized department employee. Providing a false statement to the department in connection with this affidavit will result in cancellation of the license and may result in criminal charges. The affidavit is not acceptable for the issuance of a commercial driver license. To be eligible for a CDL the person must have an SSN.
