Hi All,

Jena and I went to our local office yesterday and she had her biometrics done. The lady, who happens to be from the Philippines as is my wife, told Jena that she can't use her previous last name as her new middle name on her green card.

Jena came and got me and I basically said, it's traditional that women use there father's last name as their middle name. She told me they couldn't do that and our only choices were to either use no middle name or continue to use her former middle name which is her mothers maiden name. We chose to use no middle name for the green card. Now we are wondering what her options are. She doesn't have her green card yet since it was an appointment for biometrics only.

She also said, that if we had been married in the Philippines she could have used her fathers last name as her middle name, but since we were married in the USA she couldn't do that.

You can't do anything right now since the AOS application is already in process. If you really want to have a middle name on her Green Card, you have to wait until she receive the Green Card and apply for I-90 to change name and pay about $300+.

Your Greencard will be issued in the name you put on the AOS forms..... not the name that the ASC staff say.... check with the interviewing officer when you go for your ASO interview if you are concerned....

I hope that's the case. On the AOS forms she used her fathers last name as her middle name. We will definately be bringing this issue up in the interview.

I'm wondering if anyone else ran into the same situation. I thought that I had read that its fine to do it the way she was trying.

Many many people have done it this way and now have their greencards with their fathers name as a middle name.... the person at the ASC has no authority to change your details.....

How was the NOA1 addressed.... was her name the way you had put on the forms???

The notice was addressed to her with NO middle name.

I wonder if there is any official information that I could print out to bring with me to the interview.

I told the woman I was sure it was possible and that I had read about others doing it like that but I had no evidence to present her. It all happened very fast and she was very certain that she was right. It sounded to me like she had come across the issue before.

The person at the ASC where you had your Biometrics is not an immigration officer they can not answer immigration questions and have no say as to what name your greencard will be produced in.... They are their to capture your fingerprints and take your photo.... they do not make desissions on your case and they can not change your case.... You filed the forms using your wife's fathers last name as her middle name and that is what will be on her greencard.... if you really need to check this then make an infopass appointment at your local USCIS office and ask them what name they hold for your wife....

I used my father's last name as my new middle name when we first filed for the green card. I didn't have any problems with getting my 2-year green card and, subsequently, having the conditions removed. My 10-year green card shows my father's last name as my middle name.

If there is a law out there prohibiting this, then I will definitely want to know.

My wife used her last name as her new middle name and nobody said a word at her biometrics appointment and she has her EAD with this name. She even has her SS card that way also and no problems so far. I think the person gave you wrong information. JMO.

Just wanted to update this thread since Jena got her card.

Kezzie was absolutely correct! The card was issued with Jena's middle initial from her maiden name like she filled out the forms, not the way the woman at the office told us.
