Hello all

A friend of mine (USC) wants to file for his wife and her 3 kids under age 18. The question is does he need to file only 1 i130 for his wife and include his step children or separate forms for each individual and separate G325. I appreciate all your help.

A friend of mine (USC) wants to file for his wife and her 3 kids under age 18. The question is does he need to file only 1 i130 for his wife and include his step children or separate forms for each individual and separate G325. I appreciate all your help.

If he is the father of the children, they are U.S. citizens (but need their birth certificates filed with state dept so citizenship is recognized) and don't need an I-130, they would only be listed as accompanying his spouse. If they are not his childen, each needs a separate I-130 which chould be sent at the same time as that of his spouse.

First trip 01-17-07

Married 02-05-07

What Service Center was filed at? Nebraska transferred to California

Provide dates for the following:

I-130 sent (Mailed)..........................3-12-07

1st NOA (Receipt Notice) .................3-29-07

2nd NOA (Approval Notice) e-mail.....6-15-07

Bill for I-864 processing fee rcd and sent..7-24-07

I-864 Packet Received......................8-18-07

I-864 Mailed to NV............................8-20-07

Bill for DS-230 received....................8-29-07

Payment for DS-230 sent..................8-30-07

DS-230 Packet received..................10-25-07

DS-230 Packet sent to NVC..............10-29-07

Case Completed..............................11-16-07

Case Forwarded to Embassy.............11-30-07

Packet recieved from NVC................12-07-07

Medical complete...............................1-04-08

You would file four separate I-130 petitions, all with their own supporting documents. Pay close attention to which supporting documents apply, as they tend to vary slightly depending on age. You may put the four separate petition packages in the same envelope but they'll each need their own check for the filing fee.

Even though it is not specifically mentioned as required for filing, it is important that you include a translated copy of birth certificate for each child. This ties the family knot as evidence they are his wife's children.

Facts are cheap...knowing how to use them is precious...

Thanks for your response. He is not the father of these children so i guess he has to file 4 separate I130s. Does this mean he has to pay fee 4 times?

Unfortunately, it does. Quite a hefty fee.

Unfortunately, it does. Quite a hefty fee.

All fees will be in quadruplicate. Write separate checks for each case.
