We received a letter, not an NOA, from the USCIS telling our son (it was addressed to him) that he is being included in our petition to remove conditional status. The letter includes their ARC #s, EAC #, and all other info relating to the petition including the confirmation that he can stay and work here for up to one year or for as long as the petition is being processed.

Also, the check was cashed Dec 13 but only cleared today. Looks like everything is in good order. The only thing is my wife did not receive an NOA or formal notification of receipt. It may have burned up with the mail truck that caught fire last week. I have to verify this and call USCIS.

This is NOT the official timeline for Lifting of Conditions processing, use as reference only:

06.22.09-received both son's & wife's 10-year GC.

06.05.09-I-751 APPROVED

02.26.09-passport stamped temporary GC.

01.12.09-son's biometrics taken, after 12 months.

12.18.08-still no word from VSC

12.17.08-extended expiration date of conditional status

01.12.08-wife's biometrics taken, waiting for son's appt.

12.19.07-received NOA and EAC#

12.17.07-check cleared my account, cashed on 12.13.07

12.04.07-submitted Form I-751

01.26.06-day 150 (432): son's case approved... no interview. GC rec'd 02/11/06

12.29.05-day 121 (403): wife's case approved... no interview. GC rec'd 01/09/06

11.29.05-day 091 (373): wife's AOS & EAD biometrics done.

11.02.05-day 064 (346): EAD approved, card rec'd 12/05/05

10.15.05-day 046 (328): son's AOS biometrics done

We received my wife's NOA stating that her conditional status has been extended for one year and that she will receive an appointment from ASC for biometrics.

I'm a little bit confused and please help me. the NOA has this paragraph and I hope you guys had it too.

"If you have not already done so, provide supporting documents to assist USCIS in processing your petition and to establish eligibility to remove the conditional basis of your permanent residence. PLEASE INCLUDE A COPY OF THIS RECEIPT NOTICE WITH ANY SUPPORTING DOCUMENTS YOU SUBMIT. Such evidence may include, but not limited to the following items:

- Lease of joint tenancy or joint ownership of assets

- Joint mortgage agreement or property deed

- Tax returns

- Birth Certificates of children born from the marriage

- Joint policies of life, medical and car insurance."

This is not an RFE, right? This is just a reminder. I will still bring to biometrics what we submitted originally.

good luck all!

You don't have to take all those originals to the biometrics appointment - just the requisite ID and the bio appointment letter.

The paragraph on the NOA1 is just reminding you of the opportunity to submit proof, if you haven't already done so. (I am sure all VJers will have already sent ample proof).
