I have a very interesting question for this forum, my husband is due to remove his condition on gc. So far I have put together most of this evidence. My question is as follow: is my husband suppose to take interest/part in helping me putting the evidence together or am I due to do it all and him just sit back and wait? I had quite an argument with him on the subject and his replied was "it is your country so it is your responsability to see that my condition is removed".

Am I loosing my mind or is he outright playing me?

Someone please share your experience in that department with me!

Thank you!

Maybe he's like my husband (the USC)... he left it to me to deal with the DCF paperwork - not because he was a jerk, he's just not into paper pushing. Hope this is your case - I like giving people the benefit of the doubt.

Good luck , L.

I wouldnt't expect my wife to put an immigration filing together on her own, not just because she's only been here three years, but because it's just not something she's good at. If she messed it up, she could wind up getting denied and neither of us wants that. That doesn't mean she just sat around and watched me do it all. I filled out the form and prepared a list of the documents we needed to submit. I left it up to my wife to pull the documentation together and organize it according to the table of contents I put together.

There's no legal answer to who is responsible. Assuming you're not divorced, you've both got to sign the petition, and you're both responsible for seeing to it that what you're signing is true and not fraudulent. But either of you, or both working together, can put together the documentation.

If one of you has significantly more aptitude than the other for such things, then maybe the choice is clear. If neither has an aptitude or desire to deal with such things, then maybe it's worth hiring a lawyer to take care of it. No, I don't think most couples need a lawyer, but it can be one way of dealing with the issue, though it doesn't save you the effort of going through your files and gathering the info the lawyer will need.

But otherwise, it's one of the many shared marital duties, like shopping for groceries, taking out the trash, earning money, filing tax returns, cleaning the shower, balancing the checking account, etc. If it falls through the cracks and doesn't get done, I suppose the alien suffers more than the USC, but they both suffer. I'd think both would be pretty interested in making sure it doesn't fall through the cracks.

I'm the non-citizen and I handled all the paperwork from k3 up to now (removal of conditions) and he just asked where to sign. He hates paperwork and I am better at it. Hell, I even file our taxes since we've been married. :) It's not that he doesn't care but it just worked out that way. I know how stressful it is and I ###### at him about it but at the end of the day someone's gotta do it so it might as well be me. Good Luck!

He's wrong. Legally, it's a joint petition, meaning the two of you are obliged to file it together. (How you decide to divvy up the actual work in putting the petition together is another story.)

I have always done all the work with regard to immigration (the non USC). I suppose it depends which person is the control freak in the relationship - I know I wouldn't trust my other half to do it, so I would rather just do it myself and get him to sign where required! I just gave him a list of things that only he could get, like copies of his work insurance docs naming me as beneficiary.

Thinking about it, I am the one who makes sure all the bills are paid on time too. And I NEVER take out the trash! Each to their own! Mind you, I think I would be annoyed if I were the OP. Just kick his ###!

Hello again, and I want to say thank you for those who took the time to reply to my question, yes I am frustrated and in tears because this burden has fallen on my shoulders only, he has no interests in helping and I am sincere in saying that.

This made me uneasy around him..

Merry Xmas to all of you and good luck to all..

PS: I take the trash out....

Sorry, I have to voice my opinion, your husband sounds downright selfish. It’s not about “who should do it” but if you’re in tears over it, he should bloody-well help you.

What happens if you’re called for an interview? Will he bother going to that?

Either way, take a deep breathe, and good luck to both of you.

We’re all here for you if you need to express yourself.

Evidently, you are taking leadership in this matter and it appears he wants or needs to be led since this is your country.

So as a leader, you set up specific task for each and TELL HIM what to do.Like:

1. Make a checklist of items needed for the I751

2. Call the 800 number for asking tax transcripts for example.

3. Ask him to assemble other items as needed or send him to the copy shop to make copies of documents to be sent etc.

4. If he says this is your country then tell him that's why he must obey your orders.

:D:D:D:D

Hope it works and good luck!

Thank you Spiderette and Metta for your replies..Most of my checklist is done, all I need is a couple of letters

from friends to state that we are living together and have know us since my husband has been here..After I will be ready

to mail the application...I am very well organized, however it is the lack of interest on his part that came in to play and made me wonder?

Yes, he is a Me, Myself and I person...If we are called in for an interview well so be it..we will go!

thank you and have a good day all!
