How many people get AoS interview waived?

Hi, gang.. Nothing urgent here, just curious....

How many people (as a percentage), do you suppose get the AoS granted without an interview for marriage-based immigration? Also, what factors do you suppose come into play, and how strong do you think they are? (ie - income, home country, etc)

It is all randomly!

Others have tried in vain to find a reason or season, but no luck. It does indeed seem random.

I have counted us June filers: about 28 people had interviews and 15 got transferred to a service center for further processing. Everyone got approved but 5 people are still pending name checks.

This is what our case was, approved without interview.

Our AOS was approved without interview also. However, both hubby and I had previous marriages that were dissolved/annulled.

As stated earlier, there is no clear trend nor guidelines as to who gets approved without interview. Even if we say that those who got approved sans interview have shown proof of a valid marriage, there are a lot of people who have done the same that are called for interview.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

..............................................Notice date : 08/22/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

Correct me if I'm wrong, but I think that only K-1s and K-3s get AOS approved without interview. If you're adjusting status from an H-1B (or other work visa), or tourist visa, or student visa, it looks like you always get an interview.

Timeline

Generally, it seems that about 99.9% of those who go through without an interview are K-1 filers. Eau_explain was a B1/B2 who went through without an interview, but it seems that lately, if you're adjusting from F-1/B1/B2/VWP/J1 etc. you'll have an interview. Which makes sense, because up until mid-2007 no evidence was required in the paperwork for AOS if adjusting from those types of visas.

But again, all of it is pure speculation and with evidence now being required for the I-130, this could change. So far, doesn't seem to have changed, though.

Neither of us were married before, and I as the USC was well above the 125% poverty line with a good job, but we still had an interview.

Personally, I think some of it is randomness. In my opinion though, I also think the country your spouse is from plays a role.

Niether of us were married before, no kids involved, i make good money, no criminal records, wife's from philippines,...... very very cut and dry case, our interview is feb 2008. I think (at least around here) it's random. Maybe they play eeny meeny miney mo :lol:

But if you live in California, all people get interviews.

That is not true. John&Annie lived in CA and were transferred just off the top of my head. Also, if the country matters, then we would see a more clear pattern. We simply don't.

True. Most Cali peeps do get interviewed, and at one point, were getting their GCs faster than transferees. John & Annie certainly waited a long time for theirs - after namechecks.

There were 2 couples who filed in Cincinnati at the same time as me (not UK), they had interviews. Featherb was UK/Cincinnati as well - no interview. Jashley was Canada/Cincy - no interview. Yet an Egyptian & an Indian couple had interviews. Who knows.

We have lots of transfers and no pattern on income (I made enough in 2006 and 2007, but was below in 2005 and 2004), previous marriage, proof of relationship (K-1s don't submit anything new), or country of origin. People get held up in namechecks that were transferred, people get RFEs, so it doesn't seem to have much to do with how 'easy' an approval you are.

We have a memo that rebeccajo posted a while back about transfers based solely on how backed up the local office is. My guess would be that they transfer based primarily on that backlog, but reserve the option to transfer you out for an interview if they find something that warrants further inspection.

It has nothing to do with country, income, bonafides of the relationship, petition type.......it it PURELY based upon caseloads.

I'm surprised by the responses of some of you who have been here awhile in answering this question.
